What to do if you have a summlons to come to court.?

Generally this will be a County Court Summons not a criminal court one, as being in debt is not a crime. This on the assumption you are in England. Not paying it back is a civil offence which means that the creditor (Credit Card Company) can sue you in a Civil Court, hence the summons. Very few people attend such hearings unless they have a good defense (ie the debt is an error or the company has made a mistake). Most card companies have a 'friendly' court where all their debts are heard, one of these being Northampton County Court as that is a court specialising in such cases. Normally the card company will submit multiple applications for a judgement, say a thousand at a time. The judge will pick out a sample of around five cases and examine them. If the paperwork is right he will ask the prosecuting solicitor to confirm that all the applications are of the same standard and, on receiving an affirmative, will rubber-stamp them all. The debt is then recorded as a County Court Judgement, commonly known as a CCJ and put on the public register where anyone can search, for a fee, and find it. This will, potentially, adversely affect your credit rating as most lenders will conduct a search when applications for credit are received as part of their standard process to asses your viability as a borrower. The Court will probably not contact you but as the Order is made then you should service the debt. On the good side at least interest stops and you are at liberty to place your own statement of the reason for the outstanding debt on the public register so that anyone searching will see your side. The judgement will stay on the reguister for six years. If you pay it off it will then be recorded as a 'satisfied' debt and still stay on the register unless the lender agrees to submit an application for it to be removed. If they refuse. and this is not uncommon due to the time, trouble and expense to have it removed, you may still place a statement on the register explaining that you have repaid the debt and the reasons for the difficulty in the first place.

If you contact the company NOW and make an arrangement there is still time for the case to be cancelled so that is what I would advise you to do.

First, verify that this is a real court summons. Many creditors will send you a copy of the summons, but it was never filed nor notorized. So, being scared, you will now pay up on your debt. A quick call to the court will verify it.

If it's legit, gather whatever documents you have. Come up with a financial budget so that you can convince the judge to order a fair and reasonable payment plan. Otherwise, the creditor will garnish your wages or attach to your savings account, which will probably be much more of a hardship. In most cases the judge will order a payment plan if it's reasonable.

If you have been harrassed by the creditor, bring any proof of that with you too, it will help your case in negotiating a payment plan.

Verify the Statute of Limitations of this debt. If the default date is over a certain time, you can file for dismissal based on expiration of the SOL.

Don't panic, it's not the end of the world. Just be sure to show up so they don't issue a default judgement.

If you don't go the court then there will be a Default Judgement against you.

After default judgement creditor will register in county and there will be a judgement lien against your personal & real property in that county.


Later on creditor can get a writ of execution and have sheriff auction any or all of your property to recover the debt.

You should go to the court and try to work it out with creditor.

Definitely show up. Dress well to show the judge respect. Consult with a credit counselling agency before you go- show proof of that app't so that the judge knows that you are serious about fixing the problem, and if you can afford it, get a lawyer who can help you to strategize further and represent you in court.

Contact the credit card company to work out a acceptable,extended installment payment scheme before the due date and request them to cancel the court case.No way you can get away from debt repayment.
Failing which you had to attend the court and be prepared to face the consequence.
