What will happen if someone with unpaid credit card bills leaves the usa with no intention to return?
Let`s say one has a total of 8k outstanding balance of different credit cards. If this individual leaves the usa without paying the debts (lets say to africa or russia) will there be any criminal prosecution? Will they be able to re enter the usa?

Dr. Shakar
Debts (unless it is a fraud) are not a subject for a criminal prosecution. This is a civil matter.

The worst case scenario is they take you to court and win by default (since you will not show up in court). Judgments have a long statue of limitation and can be easily renewed. So, if you do come back to US then there is a chance that they will find you and will try to garnish your wages. In a meanwhile there is practically nothing your creditors can do to hunt you outside of US.

If they do not take you to court then after a few years a statue of limitation will expire (depends on a state, in some states SOL can be tolled once you leave the state). Once statue of limitation is expired the debt cannot be collected (by taking legal action against you).

Since you plan to leave the country for a long time then simply file bankruptcy. This way any trace of your debts will be legally erased without paying a penny and without any negative records in your credit history after 10 years. In fact, you can even stop paying your rent in between filing and discharge (about 3 months) without fear of being evicted.

Your going to have very bad credit for life !!!! Wow, you might as well say it's you that is walking away from your debt.....no biggie my friend, it's only going to hurt you......

Dirk D.
Credit card companies are international, if you didn't want to pay the balance you shouldn't have bought things. Just because you are in another country does not mean that you won't ever need credit again. It's people who do things like that who run service charges up for everyone.

you might get away with it, but you might not.

If you intend to have a professional life, or sleep well, see a debt counseller.

I expect (but I don't know) that you might be able to do a deal where they freeze the dollar amount for a few years while you pay it off..

The big issue is what sort of person you are. if you feel fine about cheating then it is only a question of whether you will get away with it.

Do they know who you are? did you show them a foreign ID when you got the card. If yes would think you are out of your mind to risk this.

Being an undischarged bankrupt in the US will mean that you cannot sleep soundly for the rest of your life, and with compound interest, even if one day you wanted to pay it off, you won't be able to

at least declare yourself bankrupt - put a cap on it,

Do some research.

Don't run away from your responsibilities

that figures, we Americans will get stuck with the bill as usual.

They can come and go as they want to. The creditors will send the account to a collection agency and try everything possible to collect. After a certain amout of time and many attempts to collect, it will be written off.
