I have recieved a letter from the court that a credit card company sues me and had made a judgement about me. This is the first time that ever happened to me. I dont want to go thru all that messed of going to the court and getting a lawyer, heck, i dont even think i can affod a lawyer. I need help here..what is the best way to solved this problem. should I answer the complaint or call their lawyer make a payment agreement or go to court? Additional Details they want me to pay them the full amount of $3,000 not including the fees and cost of the laywer and the court. |

NEGOTIATE. You need to do something before the court date and within the time to answer the complaint. I can't give you legal advice on how to answer the complaint but you might seek some help from the court as to a standard answer such as you deny this, this and this and agree that this occurred. Best thing to do in t hat case would be to get an attorney, but that will cost money..
So you can contact the credit card company. I am assuming that you do owe them and are delinquent in your payments and that the information is accurate that they claim you owe.
So when you contact them tell them that you would like to get it resolved without going to court if possible. Tell them that money is tight as they expect that. See if they would reduce the amount so you could make a payment in settlement of the entire claim. (Would you have money to do that?) If you don't have money for that, Ask them if they would reduce the interest rate or allow you not to incur any more interest charges if you make and keep a commitment to pay on a payment plan. Ask them to Freeze the amount on the card so you can't make any more charges, at least until you have it paid off. I would presume that your itnerest rate is sky high as they are vultures when it comes to increasing interest rates when you are a little bit late. They can be as high as about 30% which should be against the law, and used to be.
None of this can be legal advice as I am not an attorney now and not registered in any state where you might be. So this is just common sense and comes from a former union negotiator who knows you can negotiate just about everything. If this doesn't work and work soon, you do need to answer that complaint or otherwise they will get a judgement and then can take your home or car or anything you have. You need to stop them from doing that. So don't fail to respond in court. If nothing else, tell the clerk you want to respond and ask if there is a form and how to deny their allegations or to admit you owe if you do and deny whatever. Or that you "saith naught" - say nothing. Clerks know a lot. they can't do it for you but you could ask them how to say that. If it is in small claims court, you are in better situation to talk to the judge than in common please court.
Is there a law school clinic near you? They may be able to help you with a student in law school (like seniors) who represent you under direction of a professor.
Good luck to you. It is too bad that it got to this point and I hope that they will work with you. Some companies seem more willing to negotiate right now because many mortgages are being foreclosed and some finance companies are hurting. They might set up payments but if you could ocme up with money, you might be able to settle easier. |

If you owe the debt, you should pay. If you get a summons to appear in court, you can go without a lawyer but make sure to appear. Even if you make an agreement to pay, they will still file suit against you to enter the judgment. |

Since you have already been sued, why make the payment
arrangement with them, they got you know, so its better just
to go in front ofthe judge, and plead your case, why yougot
into that situation, maybe you lost your job, illness, people
always fall intohard times, plus you got the judge on your
side that he knows these cccompanies alwaystack on fees,
overlimit fees, high interest sobefore he makes the deciasion
ask him if he could help with removing those fees are not
part of your debt. But please you have to show up, ifnot,
theywill automaticallyget whatever they ask for, dont let them
dothat, 70-80% of cases win by default because people/
consumers are too scared and dont show up!
Even if you cant pay right away, its better to look the judge
in the eyeand explain your financial situation.

Start by contacting the attorney and see what you can negotiate. Obviously you can't pay the whole amount at once, and if he won't budge you will have to take your chances in court.
If they win (and from you answer I assume they will), you can request that the judge order a payment plan that you can afford. Check with your local court to find out the exact procedure on how to do this.
And if the attorney plans to take this to court, file a motion with the court for a validation disclosure. Make the attorney provide you with copies of the contract, and a exact accounting of what they claim you owe. I may states, they can't win without a contract, and many times they can't supply one. |

I would call the credit card company and see if it can be settled out of court. It can't hurt to ask. What motivation do they have to take you to court if they can get their money without having to do that? |

Call the credit card company and ask them if they would be willing to settle for an adjusted amount. They will most times offer to allow you to pay off for about 30-50% of what ya owe maybe less. Then take out a loan to make the one time payment on the settlement to pay off for much less and lower interest rate. Use your car for colateral for loan for an even lower interest rate. |

Negotiate. Youre probably going to court because you defaulted on a payment... so a payment plan with a lawyer wouldnt work. You could probably negotiate before even having to go to court. You might want to act fast though, because the last thing you want to do it ruin your credit. It stays on your record for 7 years! And its more bad luck than breaking mirrors!!!!! |

You can contact a debt settlement company. Debt settlement, also known as debt negotiation, is a form of online debt consolidation whereby a certified debt arbitrator, on behalf of that individual will negotiate with the creditors to reach a reduced payoff balance on their debts and that will cut your total debt, sometimes over 50%, with lower monthly payments. Once the negotiated settlement amount is agreed upon with your creditors the debt negotiation company would make a lump sum payment to them. And then you have to pay them monthly fixed amount. Thus you can clear off your debts.
