What would you do if a family member stole your credit card?
I have a credit card that was expired and I was paying it off. I had it almost completely paid off. I realized that I never got a new card in the mail but I didn't worry about it because I just wanted to pay off the card and be done with it and didn't want a new card to temp me to make purchases on it. Well today when I was paying my credit card bill I noticed about 200 dollars worth of charges. I knew immediately that my mom must have gotten ahold of my new card because she lived with us for a few months and all the charges were to the gas station she works at and the grocery store my brother works at in a city that I never even go to. So I called my mom up and after lying at first she finally admitted that she had taken it but that my sister in law had been the one to use it. Now I don't know what to do. Part of me thinks I should call the police on her but the other part of me is conflicted because she has three kids which are my adorable nephews and I don't want them to arrest her and it cause a lot of problems....but I'm just livid!!! I can't trust my family at all....what would you do if you were in my shoes?

I can understand where you are coming from. My mother got a credit card in my name without my knowledge and I was hit with a garnishment. I had to do what I had to do.

I would ask your Mother/Sister in law for all of the money up front so the bill can be paid and tell them that you will report them (and mean it). There is no time for you to feel sorry for anyone. Trust me - I've learned the hard way! Family will not fix your credit and keep in mind that interest has already started to accrue.

If they don't comply, don't feel bad by telling them that you will begin the procedure by filling out an affidavit at the bank stating you did not make those charges. Also, keep in mind that family members can keep promising they will give you the money, but never give it to you. If you don't fill out the affidavit, I would continue to pay at least the minimum amount and that is to your benefit. (of course don't tell them)

Demand the money AND the card back. Also, report the card lost or stolen so they can not continue to use it.

If they do not return the money and or the card, you have the option of calling the police or filing a small claims suit.

Because of the situation being with family, I would try and resolve it through them paying it back and returning the card first.
After that, however, you are not a charity and do what you have to to retrieve your stolen property.

I would call the police and file a police report and call the credit card company and report the theft. I absolutely would not hesitate to press charges and put them in jail.

Why should you have any consideration for a family member that STOLE from you?

As it is, the credit card company may not believe you when you report the theft of the card. They may still make you pay the bill. That's why you need to file the police report.

If you do not do anything it will happen again, and again.
She has committed fraud.
Call the credit card company, they may remove the charges without a copy of a police report.
File the report. You can drop the charges later, but at least she'll know not to do it again.
Look around make sure your jewelry is still around. Make sure your kids piggy banks are still full.

Try to resolve it without the courts first. If she pays up, try to forgive and forget and keep your cards out of her reach in the future. If she refuses to make ammends with this, I would probably consider pressing charges. Then she not only stole your card, but she refuses to make it right - showing that she has no remorse for her actions.

Will your mom and sister-in-law pay the bill off? Either way, I'd call the credit card company to cancel the card and report it missing since whatever date it's been out of your hands.

make sure who has it and why or why not they did it, just sort things as such with as little commotion as possible, if things can be sorted out in friendly way it is preferred, otherwise talk to your credit card company so that they don't hold you responsible for their actions...

take your steps carefully... there are better ways to do somethings then just jumping to the next thing that comes to mind.

Call the police. Its illegal. Just because she is your mom doesn't give her the right to do that without asking you. She probably did it because she knew you wouldn't try to do anything about it. I would ask her for the money back and if not then take legal action. You at least should ask her for the money if not tell her thats the only thing that you would have done for her (asking for it back) instead of going straight to the police.

just tell her to give you the card back, and to give you the 200 dollars. if they say no, just try to work it out. and if it still doesn't work out, threaten her, tell her you will sue (even if you aren't going to do it..)
