My husband is on dissability and I can only make small payments. The lady who called was very nasty and very mean. Made fun of our income. so I told her I would send twenty dollars a month. Not acceptable she said. She wants the full amount plus a $40.00 fee. |

yes you can make payments. Also you can ask her not to call you anymore and to only contact you by mail. By law thye have to do so. Now she wants the whole amount now because that way she gets the commision for collecting. If she can not collect on the debt the account will be passed to a different collector and so is the cycle.
You have afew options. You can ask her to send you a settlement letter for a lower amount , you can tell her not to call you anymore wait a few months and eventually you will get a settlement letter with a lower amount or you can ask to talk to her supervisor explain yourself and maybe get a payment arrangment. Odds are you will not but does not hurt to try.
You can also send the 20 dollars and keep receits that you send and they will be applied to your debt.
I worked for a collections agency before and yes I was nasty to people at times but some people deserve it. |

Well, Im a credit manager, so be careful to what you agree to. Firstly, send in the $20.00. Under the law they can't refuse the money. If they are abusive, call the State Attorney General's office Consumer Protection Division. Every Atty Gen'ls office has one. Explain the situation and they should be able to help. IF THEY (collection agency) CALLs MORE THEN 3 TIMES A WEEK, definately call the ATTy Gen'l. That is harrassment and it can get the whole debt resolved without you paying a dime. Good luck! |

Payments can always be made. Deal directly with the creditor not the collection agency. They sound slimy. |

Don't panic!! The collection agency gets 40% of what they collect. Next time they call, tell them to talk to your attorney and if they insist on calling, tell them one more call and you will declare personal bankruptcy and they will get NOTHING. I guarantee they will leave you alone if they think they are going to get nothing. The law is on your side so don't worry about it. What do they think they will do, throw you in "debtors prison"? That went out decades ago. If you pay then 10.00 a month, there is nothing they can do about it.!! I have been there and done that, got a tee shirt and a get out of jail free card. The try to scare you and bully you. laugh at them and just hang up the phone. As long as you are making an effort, you have nothing to worry about. |

They can not turn down payments, if they do and you can prove it this can be held against them. Just as long as you are making an effort, there is not squat they can do about it. Next time those idiots call, get their number and say you will call them back. Call back and talk to their supervisor and report their attitude and the fact that you want to try and resolve the debt. Those darned debt collectors can be butt heads. |

Yes, you can. The payments are considered good faith payments, even if the amount is less than what the collection agency is asking for. You can also call them up on you own & negotiate a settlement offer, which also can be made in monthly payments. The fee she spoke of is the collection agency's collecting fee that's added onto the total balance.
I'm sorry she made fun of your income & belittled you. There are collectors out there like her that are on job burnout, so they think they can speak to people in a derogatory manner. I promise you she made your situation laughable & gossiped about it to anyone who'd listen. While that's rude, uncalled for, unfair, etc, that's how collectors get when they're on job burnout or on the verge of it.
Rest assured, there ARE collectors out there with hearts that care. These are the ones you want to speak with about your debt to work on some kind of monthly payment arrangement that fits your budget. If the collection agent you're speaking with gets nasty, rude, etc, politely tell them that they're no longer helping you get a handle on the situation & that you'd feel better talking to a supevisor.
When the supervisor gets to the phone, ask him/her for identifying information. Get a first name or a Mr/Ms/Mrs Jones. Ask for his/her extention number or direct line. ALL supervisors have either one, some are lucky enough to have both, depending on the company. Do NOT let them give you another 800, 888, 877 or 866 # to call UNLESS they give you their desk extention number. Then continue the discussion about making monthly payments that suit your budget & income.
I was a collection agent for almost 4 years & was one of the best because I have a heart & would go out of my way to get the money paid back. I had a 84% payment ratio. The 16% who didn't pay were charged off, bankruptcy, debt consolidated with a loan or other credit card or the debt owner died.
I hope you find someone who will help you with your situation to get the money paid back. Best of luck to you! |

the better question is how much, and how long has it been brewing, is this the only debt not being paid, The dead beats who tell you to send a letter ceasing communication, dont know to much, Personaly they can call and contact you every day with exception of a few certin states. If you cease them. The first thing done is an asset search, depending on how many cars you have how much your paying the price of your mtg they will take you to court. secure a judgement an good luck. then you have nothing. better yet stop paying on all of your bills live in your house for free as long as you can then file banko----- you deserve it. Just dont pretend to be a victim. You should have stoped spending, when the income stoped |
