Texas Statutes of Limitation
The Texas Civil Practice & Remedies Code provides a 4-year limitations period for types of debt. The SoL begins after the day the cause of action accrues, (Section 16.004 (a) (3)).
They don't stand a chance in court. In fact the next time they call your home, please take control of the conversation by asking them for the following:
Name of caller
Name of company
Complete address of Company
Amount of Debt
Original Creditor
Open Date
Close Date
Once you get this information, please send them a debt Validation letter and a cease communication request. If you need help with this, please feel free to email me and I will lead you in the right direction.

They could be lying; typical behavior or they may in fact, have started the legal process.
Although under the FDCPA, collection agency cannot threaten you with any action they don't intend to take or are allowed to by law.
A creditor/collection agency can sue you for a debt no matter how long it's been since default. However, it's up to you to defend yourself and tell the court that the debt is over the statute of limitations and no longer collectible.
The SOL for Texas is 4 yrs. for open accounts, written contracts, oral agreements and promissary notes. |

Statue of limitations for debts in Texas is 4 years. If you haven't paid or charged on this account in 4 years then you have what is called an affirmative defense. You can use that defense in court and their case will be thrown out.

Also if the 4 years has passed, you can send them a cease and desist letter making them stop contact with you.
I highly recommend you learn your rights under the FCRA, FDCPA and Texas Financial Code. Texas is a debtors haven and they have many laws that are on the consumers side. Both links that Chingatha mentioned have great resources. |

No lawyer will call you on the phone and tell you he'll take you to court. They send letters because it has a better effect. Do not make any payments because the SOL will start all over again |

The Statute of Limitations on credit card debt is 4 years in Texas. If the account went into default or the last payment was made more than 4 years ago, the debt can't be legally collected - meaning, no collection agency or collection attorney should be contacting you. It is a violation of the Fair Debt Collection Practices Act to attempt to collect a debt that they have no legal right to collect. http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf
Write a letter to the law firm, tell them that you believe that the SOL has expired. While you're at it, request that they validate the debt. Write, "I dispute the validity of the debt. Please provide me with verification." |

Credit companies have the funds to do whatever they want. If you have not agreed to their terms you are not just in debt - you are a lawbreaker. You need to make an agreement to pay on the debt for some amount monthly - that will most of the time get them off your back. The bottom line is that they expect their money - they loaned it to you - afterall - it wasn't a gift to you. |

I have heard that some collection agencies will use tricks to call, but in this case I would check if it was a legitmate lawyers office. They do have the right to take you to court if you owe money however. |
