mother passed away with debts (credit cards, personal loans) she did not leave a will, she had no assets to her name (home, car) lived with me for awhile now creditors are calling me to pay off her debt. No executor/lawyers were involved, I had to pay her funeral expenses, now they are saying I'm suppose to also pay for her debt??? HELP - is that so??? I'd consult a lawyer on this one. I don't believe so. The only thing I can see is if you are considered her heir and they can be looking to get something from her "estate", if she had nothing in the form of assets you might have to have your lawyer show them that and they should leave you alone. Contact your local or state bar association, they should be able to give you a listing of lawyers near to you that can help you.

The estate of he deceased parent would be the first responsible. If the debt is larger than the estate, the heirs would be proportionately responsible.

Unfortunately that is true.. If she had no life insurance of any sort and you are the living closest relative.... you are on the hook....

You need to send them a CERTIFIED copy of the death certificate. If she did not own anything, then there is nothing they can do. My grandmother died with a lot of debt and my aunt sent them a certified copy of the death certificate, and they wrote off most of the debt. However, she and my aunt co-owned the house so there were a couple of bills she had to pay part of, but it wasn't too bad, and in your case, since the two of you did not co-own anything, you should be safe.

I have heard that children or family members are responsible for the debt but I really don't see how it's possible.

I guess someone has to pay for it.

You are NOT responsible for any debts from your parents unless you are co-signer to the loan. The other's who are saying otherwise are morons!

PLEASE DON'T RESPOND IF YOU DON'T KNOW THE ANSWERS!

What you do will depend on your state laws. For example, here in Michigan you would go to the probate court and open an "estate". All of your mothers property and money will be listed, and any creditors will get to take it before it's given out to anyone (will or no will).

If she had nothing, then there is noting the creditor can collect. Contact a local probate attorney and find out what you need to file with the courts.

I've heard him say that Credit cards and other personal loans the holder of the loan is just out of luck that they can't come after someone like yourself. however in the case of a home or vehicle then yes you would inherit there debt

You would inherit if she had any assets, so it's possible you might be responsible for her debts. But these people may just be desperate to try to get their money back somehow. You will want to see a lawyer to protect yourself.

Absolutley not. You will only be responsible if you co-signed. However, the estate is responsible so if you mom had anything it will likely be claimed by the creditors.

You should see a lawyer to set up an estate because if you screw up and get some money from the estate then you would be responsible to your mom's creditors.

The fact of the matter is the debtors want someone to pay the debt. They don't care who, how, or what the circumstances are.
They will lean on you as heavy as they can until you lawyer up.

Whether or not you are obligated to pay none, some, or all of the debt is up for discussion. GET A LAWYER!

Once debtors know you have a lawyer most often they will offer to settle at a much lower amount. A lawyer may be able to get you out of some or all of the debt.

The debtors don't care about you or your mother. They only want the money. And if the guy who keeps calling you doesn't get the money he will lose his job, and that is the only thing he is worried about.

When my father passed, I was not obligated to pay his debt. When creditors called I advised he was deceased and sent a legal document (death certificate) if asked and that was the end of it.

Don't let anyone intimidate you into thinking you have to pay for these debts as long as you did not co-sign any documentation.

Debts are not inheritable. Any debts owed by the deceased are paid from his or her estate and any remaining assests are then distributed to the inheritors. If the estate is not large enough to pay the debts, the creditors must take the loss, providing there are no co-signers involved. Never pay money to someone you have not made a contract with, regardless of what they say.
