When i get married, do i marry my husbands debt. More specific, his child support?

chelle
Not sure what you mean...if you mean will it affect your credit score I don't believe so. But yes, he will still have to pay child support even though he married you. Does that answer your question??

Studly
Again, lots of terrible answers. Nikie, you need to do your research!

When you marry, you are not responsible for your spouses debts. They will not appear on your credit report. They will not sue you, garnish your wages, or take your bank accounts. Each of you have seperate credit histories, and unless you jointly sign for a loan after you are married, it will remain that way.

But on the other hand....it does effect you in many ways.

If you share bank accounts, they can take money from it. Even if most of it is your money, if any is his they will take it.

Any property he owns can be taken. So if he's the main breadwinner, then your home, car, and property is at risk.

His income can be garnished, and since he is the breadwinner, that will effect you.

If you have a job, they can NOT garnish your wages or seize property in YOUR name. It is important that you keep a bank account in your name only and do not mix your income with his.

I don't know the state you live in so I can't give much more info. Each state does treat debt a little differantly.

Credit is married into but child support is still his responsibility. If they garnish... they only garnish his. BUT take all household income into effect for the amount to be paid.

Yeah, it's pretty much a whole package. My daughter married a guy...that it seems the more time passes....the more luggage he came with....

Nikie
Of course you do. If he is late on payments child supports reports to all credit bureau's so it reflects on the both of you. When you get married your credit is seen as a "team" so his child support is considered a debt and could raise your debt to income if your bills are too high

DaMan
Why are you so worried?

You get what you get when you marry trifling men!

If he can't pay for the baby, THEN DON'T have the BABY.

It really is as simple as that.

No...you will have a seperate credit file...and so will he!

Yes. His debt is your debt after you get married.

Yes, you get all of his debt including child support. Congratulations!

In US it depends on the state........most state no you don't unless you have joint accounts...sign a prenuptial

Big Bear
No, it's not your responsibility if that is what you are asking.
But if your husband doesn't pay it for some reason, the ex can garnish his wages or put a lien on any property the two of you own together. (basically HIS portion or half of the property).

He is responsible for child support until the child emancipates (18 or 19) depending on what state you are in as well as if there are provisions for the child attending college. The only problems are if he falls behind and then most states charge interest each month. You are not responsible for his child support but it can affect you should he be behind because most states can intercept his income tax and you will have to notify them that you want your part of the income taxes should you file joint. Marriage is a union and what happens to one partner affects the other partners.

get this in writing that his pre marriage debt is his. see your attorney.

Morey000
Sounds like you should get a pre-nuptual agreement so that you both can lay down your concerns and needs and get the out in the open before you get married. Typically, assets and liabilities that one person has prior to marriage do not inherently become their spouses- so legally, you're probably safe.

Does he expect you to pay for his child support? It's not an unreasonable question to ask him.

Your debts do become community property.
But no He is the only one responsible for the child support....you can even sign a form on your income tax for exclution of your part of income tax refund.

Just as his wife is responsible for the care of those children on all levels - he is too!

it depends upon the state you are in. in some states it is based on household income. also if you have a pre-nup you may have that state you are not responsible for that debt.
