i stupidly co signed for a loan with my ex five years ago. I recently found out that my ex has not paid this loan for a year! instead the bank decide to go into my account and take out some money for this WITHOUT my permission. Not only this i know yes i am elegible to pay half of this loan therefore can the bank make me pay the full amount? i'm standing my ground as the reason this loan was taken out was so my ex could consolidate all his debts. Due to him not making his payments as was promised by him my bank has put a withdrawal block on my account - my wages go in today and i need them to live. not only this but they have cancelled all my direct debits and are refusing to take the bar off my account unless the loan payments are bought up to standard - they are asking for £3500 - i dont even earn this a month! where do i stand i need help in this as its driving me insane!!!!! thanks in advance |

I think most answers are useful help for you to solve your problems with the bank. I just want to add that the relationships between banks and their customers are of utmost importance And is widely known as "Good Bankers and Customers Relationship" This relationship must be maintained at all cost until the banks have returned their customers deposits or when the customers have repaid off their loans or mortgages which they have taken from the banks. During difficult time or economic slowdowns, customers may have problems to service the instalments payments or repay their mortgage loans, banks should help to finds ways for their customers to overcome their problems. Banks should not during difficult time, demand back their money back and take foreclosure actions like short selling the properties which they hold as security for the mortgage loans. Such actions will make their customers homeless and bad for the housing industry and also aggravate the economic situations. Banks should not be like the saying "an early bird that gets its worms." |

Maybe talk to a lawyer, but the bank does not care who it gets its money from and it will go for the easy (and legal) route: YOU. I work at a bank and this happens often - women in particular often end up being screwed like this. Let this be a lesson and never sign up for debt with someone else again, no matter how much you think you love them. |

The bank is not taking money without your permission. You gave them permission when you were stupid enough to sign the form.
You must immediately stop your wages from being paid in to your bank so that you have some control.
Make a realistic plan for paying the bank back over a period of time and when they want you to pay more than a realistic amount which they almost certainly will, then tell them to take you to court. The court will only expect you to pay a reasonable amount. |

I hate to inform you that if you cosigned for a loan...no matter what the reason... they didn't take the money out without permission, your co-signing gave them permission when your ex defaulted on the loan. If he doesn't pay the bill, you can take him to court and try and recover the money, but you are still responsible to pay the loan if he does not. |

personally if it was me and its probably not very ethical, i would ask my company to cancel the cheque and reissue it, that way the bank cant take yr money. whilst u r responsible for half the payments they surely cant take all yr money without any notice to you. i would put yr cheque in another account or open another one or get yr company to pay u cash for this one time whilst u get advice on where u stand. try citizens advice as a start. good luck. |

that's terrible, go into the bank as soon as you can and talk to the bank manager and see what the banj can do for you. i would open a new account at another bank that is not affiliated with you current bank, as soon as you can and have all you direct deposits moved into the new account. then id get a hold of him and tell him he owes you a lot of money and then call a lawyer, tomorrow! |

well as far as my understanding goes, when you cosign you are saying that if the other party (your ex) can not or does not pay, you will also be held reliable for 100% of the balance. i am assuming that the loan and your bank account are at the same bank. if i were you i would cancel my direct deposit and go in and speak with the bank manager to see if there is someway of resolving this. this will reflect poorly on your credit as well, so you may also want to get in touch with your ex. best of luck.

If this is UK then you would have signed a Consumer Credit Act loan agreement. In all cases that I ever been aware you will be jointly and severally liable for the full balance until the loan is repaid in full. n other words you are liable to repay the full amount. Ask for a copy of the agreement though just to make sure.
If this is the case try and negotiate a a repayment plan. You can ask them to split the debt but in reality why would they. They have you on the hook I am afraid
As for your other point about helping themselves to your money. The banks usually have a right of set off which means they can use credit balances to offset loans and overdraft etc. My advice is to move your income to another bank until this looks like sorting itself |

not sure over there but in USA. You cosigned therefore you are as responsible for the debt as he is. You may be able to take him to court for reimbursement though |
