Who can I contact in regards to a law firm harrassing me about a credit card account I have no knowledge of?
I have been contacted by a law firm who is threatening to sue. They only have my name. No phone number (They called my parents?), no address, NO SOCIAL SECURITY NUMBER, nothing on any of my credit reports, etc....The account is supposedly from 1 1/2 years ago. I did have delinquent credit card accounts from a failed business but settled them all out. I would assume that if I had another account that the company would have said something when I was negotiating payment. What type of lawyer, if any, should I contact to look into this?

The way you state it, it sounds like you filed BK and if this was not included then yes you might still have a creditor out there that you forgot.

How could they know you were negotiating your debts?

Contact them and demand "Proof of Debt." Tell them to not contact you again until they have the POD.

First...never assume that any legal threat for debt collection is a real legal threat. Debt collectors love nothing more than to pretend to be/represent attorneys when this is not the case. Second, when you settled your old accounts...did you get written agreements stating that the account will be settled in full for each account?

When a debt collector first contacts you, your first step should always be to request validation of the debt per your rights under the Fair Debt Collection Practices Act. Even if the debt is valid, request validation anyway.

Send them a letter via Certified Mail + Return Receipt stating:

Per the Fair Debt Collection Practices Act, I am requesting written validation of this alleged debt, which includes:

- a copy of the original signed contract with my signature
- validation of the original "Date of Delinquency" for this alleged debt
- validation of the "Date of Last Activity" for this alleged debt

Per the Fair Debt Collection Practices Act, I would like the full name of the attorney who will be taking action against me and his/her license # in the state bar association. I will be calling the state bar association to verify your attorney's information.

* DO NOT sign your signature on any document that you mail to a debt collector. It could end up on a forged document that can be used against you. Simply type your full name.

When they call back, tell them: I have sent a certified letter to your office officially requesting written validation of this alleged debt per my rights under the Fair Debt Collection Practices Act.

Per this federal law they must provide written validation within 30 days and they must cease collection activity until they send you written validation. Do not let them scare you with bogus threats during this period.

* By themselves, debt collectors have absolutely NO legal power over you. They cannot garnish your wages or freeze checking accounts...only a court can authorize this and they’d have to go through the court system to do this.
* Debt collectors have NO power whatsoever to have you arrested/sent to jail for not paying them.

contact the threatening one and demand proof that you owe any thing in writing as it may be something over looked. Then if not yours they must validate it with a social that matches yours. If they cannot do this then tell them to cease and desist or you will sue them for unfair collection action. They must validate the debt and the original creditor.

You need to look and see whats on your credit and see if there is a credit card on there and if not then someones trying to get your info to get one! Be care full don't give them ANY info

You need to obtain the name and address of the law firm representing this alledged account. Have any lawyer you know write them a letter requesting full details of the account. Once you are provided that info, you can go from there and threaten further action for harassment.

First and foremost, you need to learn your rights under the FDCPA and if this law firm violates those rights, consider a lawsuit against them.

As far as complaints go, here is the list I use.

- The Better Business Bureau
- The Attorney General of your state
- The Attorney General of their state
- The Federal Trade Commission
- Any news channels or newspapers in your area who have consumer protection teams. (Optional)

I recommend that you not under any circumstance give them any information. Do not give your SS#, address, phone. If this is a legitimate claim they will already have this information.
