First my war cry...you are about to go to war. Do NOT fight these guys unarmed. Knowledge of the law is your only weapon!

Read the link below. This is the Fair Debt Collections Act. All the answers you need are right here.

The federal agency in charge is the Federal Trade Commission (FTC). As noted in the law, they have "Administrative" control over collection agencies. But that's not what you want.

Read the law below....

§ 805. Communication in connection with debt collection [15 USC 1692c]

(a) COMMUNICATION WITH THE CONSUMER GENERALLY. Without the prior consent of the consumer given directly to the debt collector or the express permission of a court of competent jurisdiction, a debt collector may not communicate with a consumer in connection with the collection of any debt --

(3) at the consumer's place of employment if the debt collector knows or has reason to know that the consumer's employer prohibits the consumer from receiving such communication.

Therefore, your first step is to contactthe collection agency, and give them a "cease and desist" order. Be sure to put in the letter that they must not contact you at your place of employment.

Send this letter by certified mail. You don't need a return receipt because you have a tracking number on the certified mail slip they give you. Go online and get the delivery confermation and save yourself the return receipt fee.

Now, if they call you again, on to Step #2!

§ 813. Civil liability [15 USC 1692k]

(a) Except as otherwise provided by this section, any debt collector who fails to comply with any provision of this title with respect to any person is liable to such person in an amount equal to the sum of --

(1) any actual damage sustained by such person as a result of such failure;

(2) (A) in the case of any action by an individual, such additional damages as the court may allow, but not exceeding $1,000;
(3) in the case of any successful action to enforce the foregoing liability, the costs of the action, together with a reasonable attorney's fee as determined by the court. On a finding by the court that an action under this section was brought in bad faith and for the purpose of harassment, the court may award to the defendant attorney's fees reasonable in relation to the work expended and costs.

Therefore, if they call your employer, and he would agree to appear in court, you have a slam-dunk court case. Run down to small claims court and file a suit against them for $1000. The cost is around $25 for this. And you can add that cost to what they pay you.

The reason collection agents get away with this crap is because you don't know the law. They are ARMED! They alreadly know the law. Now you do too!

Actually it is illegal for them to call you at work if you've told them not to. In some states like California, they can call your work only once...to verify employment..and they can't state that they're a collection agency.

Report them to your state Attorney's General office and to the Federal Trade Commision.

well i presume you cannot stop an collection agency to call on you for collection of money that is due to them, but what you could do is to speak to your loaner and ask him for time and till that time those collection guys will not appear

first you need to write down the name of a person who calls explaining the reasons, then ask him to talk to his supervisor. usually this works. because it is actually illegal for any colection agency to call you at work and they can be fined for that.

You write them a letter to them asking them to stop. In the letter, list all the dates and times that they called, and say in the letter that you have asked them repeatedly to stop. Sign the letter, and keep a copy for yourself, in case you have to take them to court.
Be sure to date the letter, documenting EVERYTHING in the letter. They will stop, but they may start back after a few months. (They will pass it to another agent, or another company may buy the debt). When they start back, send them a copy of the old letter, attached to the new one saying how you are going to "take further action" if they don't stopp calling you at work, and that they are in violation of the Fair Credit Act. {Don't say what the further action is.} Tell them they may contact you by mail only.

In your spare time you need to look up the Fair Credit Act on the Internet and read it. It is a must read for all who have credit. Creditors play on fear of consumers because they don't know consumers don't read and don't know their rights.

Tell them (preferably in writing) that you do not wish to be called at work. They are not prohibited from calling you at work, and they work on commission, so they're going to try to harrass you as much as possible to get their money. However, if you tell them not to call you at work, they are required by law to respect that.

I work in a front office where we have employees out in the shop. We occasionally have creditors call for the guys. Next time they call, tell them I have asked you to stop calling me at work and if you do not I will involve a lawyer in this matter. That may work better if you pretend to be someone else though!!! If they have a number other than your work number, calling you at work SHOULD be considered harassment. Offer to start making payments on your debt and if they won't accept the payment you offer, that is the same as them saying you don't owe them anything.....supposedly...

My boyfriend used to work for a collections agency, and in order to get them to stop calling you, you must tell them to remove your name out of their database, or remove your name off of their collections list. They should stop calling you then.

Simply send a certified letter to the collection agency calling you stating that you CEASE all communications. Include the work number they call you at as a number you are ceasing. One more call...give the letter to a lawyer...and you have yourself a lawsuit...that you will WIN...

Actually the fair debt collection act of 1987 I believe states that they can't harass you at your place of employment. If you pay them $10 A MONTH THEY CANT BOTHER YOU.

I would also contact the lender and set up a payment plan. If this collections agency is really harassing you needlessly, you could always try reporting them to the Better Business Bureau.

if it is a 3rd party collector (company working for the actual creditor) and you tell them to stop and they don't, they are violating the fair debt collection practices. you need to bring that to their attention. However, if it is the actual creditor, that rule does not apply because they are m=not bound by the fair debt collection practices as they are not considered 3rd party. Any pymt arrangements you make, stick to them....try calling them before they call you. work with them and pay what you owe.
