If you live in one of the following states you may have a problem:
* Arizona
* California
* Idaho
* Louisiana
* Nevada
* New Mexico
* Texas
* Washington
* Wisconsin
These are "community property" states. If you opened a credit card while you were married, both spouses are responsible for the debt.
In the other states, only the person owning the card is responsible. However, a good collection has ways to recover something.
Example? If they wife keeps her money in the same account as the husband, the money can be taken out.
In your case, it depends on who owns the car. And if the mother has any money coming in she should consider opening her own account. |

was his mother and father married? if not then the father will have to deal with it if so and the mother was on the account then the mother will. even so if they were married they may try to come after her still. a great site for financial advice is www.daveramsey.com he has a radio program which you can listen to on line and because of him we are out of debt all but the house. we never bought any of his products either. tell your friend good luck |

If there is no co-signer ther is no one else responsible for the debt. However collectors may be able to take possession pf goods from your friend's father, which could include things that are also owned my his mother, like car, house or any other assets. But I believe that unless it is repossession of items that created the debt, they would need a court order for that. But it might happen evenually. And interests and fees might have increased the debt by then. |

Many will try to make her responsible but she is not (varies by state).
However creditors can lay claims and/or leans on things she has in her possession that are his or they can prove a portion of is his. So they can place a lean on a house or car, very likely. They can take stuff (after due process eg court) that is/was his though they usually don't want this crap. |

like previous answer, other people don't have to pay it unless there is a legal/contractual reason they need to
be careful, people trying to collect the money may claim that they have the right to make you or somebody else pay it
creditors may have the ability to repossess things and go after any assets your friend's father has or has partial interest in |
