if their was no co-signer, her estate but if it was credit card debt, i doubt their coming after her estate for what, 2-5 grand? look sell her assets as fast as you can ,mail the debtor a copy of her death certificate, and tell them to go to hell.... |

the debt should be wiped as the debts were in yr mothers name only witch leaves no one Else responsible for them my grandfather had this problem when my nan died he was told he was to pay them back but went to see a solicitor and he got it sorted out as only my nans name was on the debts so that meant only she was responsible for them. |

As per Income Tax rules her personal estate is purely liable for it But not on all situations.Mr/Ms Anu u didnt state what the deceased mother is...means is she physically incapable or mentally of unsound( in case of mental unsoundness she cannot hold a credit card in her name). As per Income tax the words Deceased varies from Dependent.So please mention the exact status of the mother as , is she Deceased or dependent or on what basis she hold credit card ( by her own savings on the card holding bank or by the Estate's account on the Bank). I could conclude u the answer if u exactly state the status of the mother |

Read the following Carefully!
1. All Credit Cards, at the time of joining will have a nominee's name written by the applicant.
Situation A: If the nominee's name is available on application and such nominee is NOT dead, not incapable of entering a contract, not a minor - In this case credit card company can sue the nominee for recovery of amount. However, they have to prove to the court of law (Only Civil Liability) that the named nominee is really the same person standing before the court (this is most difficult). Therefore do not committ any thing which makes your proof as you have accepted nomination (i.e. answering their letters, issuing cheques, or anything in writing). Let the credit card company find its own LEGAL way to prove that nominee is liable.
Even in this case, nominee or legal representative status must be proved ONLY, ONLY & ONLY by the card issuer. One can always deny that fact, but not against valid proof.
Situation B: No nominee is present in the contract form. Still it contains a clause that Legal heir, representatives are liable.
Again Be careful! It is only the company which has to prove that you are legal rep. heir. So, no written committments.
IF THE COMPANY RESORTS TO Recovery Agents (Illegal Process), from day 1 ASK THEM ALL to get out of sight! Tell them clearly that COMPANY MAY OPT FOR POLICE COMPLAINT (which normally they say to threaten you, but since this is a civil matter, police case CAN NEVER BE REGISTERED).
DONT ANSWER! Even if you do so, speak out only ONE answer. If you speak more I will file a nusense case against you people. (Don't Do It!) After a year or two company goes to court. It takes another 20 years to settle it. Even if the judgement comes that You should pay, you simply say I CAN PAY ONLY Rs.100/- per month or so. SO if you have will It lapses. If you have GUTS, you will practically NEVER PAY.
NEVER RUN AWAY FROM PROBLEMS! FACE THEM!
IF ONLY YOU FACE IT, PROBLEM GETS KILLED! LEST IT LIVES AND YOU ONLY KEEP RUNNING AROUND!!!!!!!!!

(by the by, if it is something less than twenty thousand, pay it and forget it. Even if it is one lakh get a OTS offer and pay off @ 20% or so. HAVE PEACE!!!!!) |

her estate -her left over money ,house car ect they will patition the court to sell the stuff at fair market value an get there money . get a lawyer if there is a large sum involved .they might take a lower one time payment. if she doesnt have any estate left and she was her own guardian then they are out of luck .you cant get money out of a corpse . good luck dont try to hide her assets if they are documented you could get in trouble .but do take her rings jewerly and stuff like that that cant be traced . dont try to take money out of bank ect. |

From what l know, a dead person's credit card debt goes forfeited. lt is the person's own card and no one can be forced to pay for it. That is if he/she owns it and no one else. lnform the company about the death. Legal papers have to be presented.
That's how it is in my country. l hope it's the same there. |
