They threat all the time to do this and do that. Its a ploy to scare us into paying or just get the upper hand in the conversation. But when it comes down to it, they dont do what they threaten. FDCPA, and other current laws put into place... to protect us who are faced to deal with debt collectors, and unfare practices they have. They still continue to break the laws. So can anyone really answer this question correctly?
BTW, I got my taxes! Oh, Didnt I already Say That? A shame, when they attempted to scare me by freezing my checking account and savings account, with nothing in them. Seriously, if a person is broke, do you really expect to get any money? |

Typically, debt collectors who call you are told what to say and don't really know all the circumstances. A guy I worked with stop showing up for work. A debt collector kept calling work looking for him. When I explained that I have no idea where he was, the collector kept saying the same lines over and over again. Finally I asked if they were even listening to me!
Some of their threats do hold true. My friend had an outstanding balance on her credit card for a long time and the credit card company garnished her wages. Another friend was told that she was going to be put on a "black list" and wouldn't be able to open a bank account at most banks. She thought they were full of it, but it was actually true! And then there was a credit card company that called my house asking if so-and-so still lived next door to me because they were dodging phone calls and not answering letters. My neighbor has no idea how they got my phone number. If you can't pay your debt, your best bet is to just pay a little at a time just to shut them up. |

I guess this is a rant instead of a question.....Yes, there are a lot of vicious debt collectors out there that violate the FDCPA.....The bad thing is....many consumers do not understand that they have rights....so when I debt collector makes bogus threats...they believe them.......We live in a nation where people are too distracted with Paris Hilton and Britney to bother empowering themselves knowledge about their rights ....and they pay a price....
There are debt collectors out there who are now impersonating federal agents....who threaten imminent arrest if you don't give them your credit card number immediately... |

Some debt collectors do lie to try and scare you. But they are dealing with people who ran up debts and fail to live up to their end of the contract and pay. These debtors tend to tell outrageous lies, too.
By the way, if they froze your bank accounts, that means they must have a judgment. They couldn't attach your taxes, but they can garnish your wages and lien any other property you may have. Even if you aren't working and don't have anything now, those judgments are usually good for 10 years and can be renewed. They can wait till you do have something worth taking. |

Simply put, they bank on the average debtors ignorance of the law and scare/bully people into paying debts. I have no respect for people like that.
That's why I'm very grateful and proud of people like Smooth, Slimick, Echo, Bryan, Studly and others who come here and educate people on their rights. I've learned alot from them and try to "pay it forward" by doing my part to spread the word.
My mother is actually a collection agent for Macy's (not a junk debt buyer) and I've seen and heard how they work. They actually their jobs in a way that benefits the customer (lower interest rates, negative marks removed from credit etc) and FOLLOW THROUGH on it, and as such the customers appreciate that and are more willing to pay. They do it the right way. |

they will bring suit against you and if they get a judgement,they can and will garnish your wages and freeze your bank acct.they can never take your taxes,only a govt agency can do that.just be careful |

seems like there is a question like this every day. check out this post yesterday, they were badgering someone that lost her job. she was ready to pay them half of her refund past the states SOL. I would report them to the FTC, your state attorney generals office for this bad behavior.

i work in hsbc collections deparment i make those type of calls, i also say anything i got to say because i get my hourly money but get lots of bonuses if i get customers to pay there over due bill! i can tell you that they will say lots of things but most of them are not true! |

why do people think it's ok to run up debt and not pay it off? if they take you to court and get a judgement---they will get your refund. just be a decent human being and pay your debts. |
