Why am I finding impossible to get someone to pay a debt even if he has the means (money, property) to pay?
I lent some money to a friend who now refuses to pay it back despite having the means to do so. Normal legal procedure won't work because I realised too late that is a serial debtor and know all the tricks of how to avoid paying.
There is plenty on the web the rights of debtors and how to avoid payment, but very little on how to help creditors get their money back.

That is beacuse the law is loaded on the side of the debtor. There are due processes of law and if you have concrete evidence of the debt, then you bWILL win the legal fight eventually, but it is a huge expense up front (which you will likely get back in costs). However, the court then allow time to pay, do not chase up defaulters and all in all you end up no better off. You will also find that if you take things into your own hands by taking property from them, you will end up charged with theft. If you can sell on the debt to a collection agecny, this is your only chance of getting anything back on the deal. Plus your 'friend' will have to deal with some very real and direct methods of getting people to pay their debts.

You can take this through a small claims court, but you dont give any details so i carn't advise on how likly you are to win.


Firstly; How much did you lend?
How did you lend? cash?
Is this person actualy your friend?
Have you talked this through with a legal advisor?

If you dont want to give out these details email me and ill advise further.

sell the debt to a non licensed money lender, you will get about 50% back the debt collector will get the other r50% and your friend will get medical treatment

Well, if your friend wount pay it back, it really isn't your friend is it?
I would treat this as a learning experience. Never lend money out to people you don't know. That's the job of banks. they are professionals.

My dad always told me "never lend money to family or friends" I always thought that was a bit harsh but after being burned by a friend who I lent money to, my dad was right.
Sadly it looks like you've been burned too, cut all ties with this 'friend' and be a bit smarter next time. Good luck

Depending on the amount...place the debt in the hands of a collection agency. They will collect the debt on your behalf for a commission.

The con-man was asked....'How can you cheat people who trust and befriend you?'

His reply was....'If they don't trust and befriend me I can't cheat 'em'.

It would seem you have put your trust in the wrong person..with no paperwork......chalk it up to experience and forget all about it.

Just innocently ask to borrow some of his stuff, then when he asks for it back, just answer "Oh yeah, where's my money?"

P.S. I'd suggest you borrow something you like vs. something valuable that you might never use, that way if he never asks for it back, at least your using it.

"a borrower nor a lender be" thats my motto

but failing that you can try the small claims court, see a solicitor, maybe getting a letter from them will show him you mean business, if not try a heavy handed debt collector, even if he tries to avoid payment they will just get an order to seaze goods from his home to the value of whatever he owes you plus the debt collectors rate on top of that!

advice wise.... dont lend out money again, specially large amounts, i dont lend or borrow and its got me through life fine.... i dont mind helping good friends out with a couple of quid when needed but i tell um its a gift not a lend as theres nothing worse than chasing a friend for money they owe.

money and mates dont mix!
