Design Gal | Why are these debts still on my credit report after 7 years? |
I recently visited freecreditreport.com and got my credit score. When I was 18 years old, I got three credit cards in the mail. I had no job since I was going to college full time and used the $2200 in cards for books/expenses. I stopped paying them in 2001 because my family moved and forgot to keep up with the bills as they weren't being sent to me. Now I graduated from college with my masters and this old debt is still on my account. It's been 7 years since the last activity was in 2001 so why on earth are these old credit cards still on my credit report? I been keeping up with my other payments but my score is poor! I can't pay them because I owe 50k in debt for school and have to pay that every month. |

If you stopped paying them in 2001 it should be gone this year or by early '09. Depending on what month you actually stopped paying.
Negative debts are only reported for 7 yrs.
The 7-year period shall begin, with respect to any delinquent account that is placed for collection (internally or by referral to a third party, whichever is earlier), charged to profit and loss, or subject to any similar action, upon the expiration of the 180-day period beginning on the date of the commencement of the delinquency which immediately preceded the collection activity, charge to profit and loss, or similar action.
A payment was due on January 10, 2007 but, you failed to make that payment and never made another payment. The creditor waits until August '07to take action (charge off, send to collections, sell/transfer debt, etc.) on the debt.
The 180 day count began on January '07, (your last missed payment month) and runs until July '07 at which time the seven (7) year reporting period begins and runs until July 2014.
**Statute of limitation is not the same thing as the reporting period. The 7 yr. reporting period is federally mandated and doesn't vary from state to state. However, the SOL date does. The SOL date is how long a creditor has to seek legal remedy.
Making payments or reselling the debt does not restart the reporting period. However, making payments can restart the SOL.
Also making any payments now would make your credit even worse.
If you feel the need to pay off the debt, wait until it falls off your credit reports. |

credit card debt does have a statute of limitation. However, this varies from state to state. Here is a link to find out how long it will take for your bad debt to fall off:

my mom has the same problem with some things on her credit report and they do get off your credit report after 7 years but its 7 years from the time they are opened. like my mom had something from sept of 99 and it juss got off her credit report at the end of sept this past year. its quarterly also. So if u opened them between now and march it should be off by the end of march this year. Or if it was between march and june it should be off by the end of june and etc. |

Good Evening,
I will not pretend to be a credit expert but i might have a solution for you. First i think that some debts can remain on record for longer then 7 years not sure which ones. I recently found a couple of items that i had paid off still on my record. So i went to all three bureau's and used there dispute online option to fight the incorrect debt. Well thinking it was easy enough to dispute I went ahead and disputed everything on my record. WOW IT WORKED. I started out with about 5500 dollars in unpaid debt (most of it I owed) after the dispute was complete i only owed 2200. The thing about it is each company you owe (legit or not) you dispute they have to contact the bureau to say YES or NO the debts is yours. If these company's do not respond in 30 days it will be erased from your record. YOU DON'T EVEN SEE ANYTHING ABOUT IT ON YOUR CREDIT REPORT. I have done this for two months and items fell off each month. Of course a couple came back already been disputed.
I wont ramble on to much more but i certainly wanted to share because disputes work. Just go to all three bureau's and there is links that will guide you to the online dispute. You will need the report numbers off of the report you got from annualcredit report.com Good Luck hope this helped. |

As far as I know, those debts can only be discharged in a bankruptcy.
You should have been sued if you did not get a bankruptcy. |

I am not sure i understand your question right? If you used the credit cards before, even though you haven't pay them for 7 years, it won't just go away??? As long as you carry a balance (debt) with that card, it is still active, they won't wipe out your balance even you ignore the bill. |

It's on your credit report because you still owe them money. Once you pay them off, it will go away, but it will take a long time for your credit score to go up. Debt doesn't just go away if you ignore it. |

The debt goes away in 7 years IF you declare bankruptcy. If you don't, then they last forever. You need to consult a service that will help you reduce your debt over time, and to consult your student loan company and see if you can make reduced payments while you clear your credit. |

It takes 10 years for thing to be erased from your credit report. |

You must rectify those OLD CREDIT CARD BALANCES they don't just 'go away'. |

Debt USE to go away after 7 years after you declared bancruptcy. Now it doesn't go away at all only the payment is restructured. Since you never declared bancruptcy the clock never started ticking. You need to contact them ASAP. If you pay nothing you could be looking at Felony Fraud since its over $1500.
Time for a second job. |
