janthonyr123 | Why did they take my stimulus check? |
they took my stimulus check for a student loan that my wife owed from a previous marriage. she does not work and the income comes solely from me. how in the heck can they do that? i got a letter saying we were getting $1800 and when the check came it was for $179 because they took the rest. this is such bullcrap. i just dont understand how they can take my money for a debt that isnt even mine. is there a way to get it back? |

I think you should just be happy the debt is now paid and won't follow you and your wife any longer. |

If you are married then you assume her debt as well. you filed jointly to get the bigger tax break and that sword cuts both ways. |

Because you and your wife most likely filed jointly. Well, your wife owed the taxpayers some money, what's right is right. It would have been the right thing to do to pay them back with your $1800.00 (and ethical, too), but it is unfortunate that the government had to resort to that in order to collect a debt that you and I were being forced to carry because of her non-payment. Now the loan is paid off; the taxpayer is paid off, your wife's conscience is clear, so go on, enjoy the $179 with a nice dinner out for the whole family. Also, we all know that spouses come with some baggage whether it's debt, crazy ex, or just plain craziness. If you love your spouse you accept everything that she came with and move on. Doesn't sound fair to you, but it makes a whole lot of sense to the taxpayers who have had to carry your wife's debt for a while.
Congratulations to your wife for finally paying her debt to us taxpayers.
Have fun |

When you are married you share eachothers love AND DEBT. If she has any debt or you have any debt it could have gone either way and since this was a student loan probably from a Government program - they caught you. :(
It sucks but I'm sure you're not the only one. |

The money was taken because your wife is on your taxes. She is entitiled to a portion of your return. You could have possibly filed "injured spouse" and preserved some of the money. You can contact the IRS and see if they will allow to do that. |

If you filed a joint tax return - in the eyes of the IRS that check belonged as much to your wife as you. Doesn't matter who actually earns the $$ |

If she isn't working and you claim her as a dependent then they will garnish your wages. That money is for her as well. Though they may not take your income they will take any money they see as for her. Some people get bad habits when you get married you got her unpaid debt. LUCKY YOU!!! |

When you married your wife, you also "married" any debts she may have had. I know it's bull, but that's just the way it goes. At least now you have that debt paid and you don't have to worry about it still being on your credit. |

the stipulations for the stimulus check is that you do not owe the government money, if you owe the government money, then the money from the check goes to paying the government back, whether you like it or not....
there is not way to get it back that i know of, but maybe call an attorney, for a free consulation and they may be able to help you...otherwise talk to your state attorney and see what he has to say...
it is a load of bs...
sorry, and good luck |

It's the IRS they can take it and they will. If you filed jointly and she has that existing loan that has defaulted they took the money from you both of you because it was hers to legally. |

Because it's a legitimate debt of your wife's and she was included in your tax return - which means it was HER money too, so if she owed a debt and filed taxes, they can take her debt from her tax return. You guys should have filed separately. |

Because when you get married, everything is split equally. Your debt becomes her problema and her debt becomes yours. There's no way of getting that money back. |

If you joint filed on your federal taxes, they can take that money for any federal debt that you (or your wife) may owe. Student loans are considered federal debt. If you didn't file jointly, then I'd give someone a call and see what the heck is going on. Good luck! |

If she would have claimed (injured spouse- is what they call it) then none of her depts are yours and vise versa ! Well the bright side is that its paid and neither of you have to worry about it agin..
GREAT...now I guess I should expect them to keep mine too....sucky drag |

The government can do what they want. you obviously had her SS# tied to yours somehow. You know the saying whats mine is yours? well that goes for everything. I had my wages garnished for state income taxes that were my husbands where a former employer did a 1099 on him. They couldn't garnish him because he was getting paid cash, and they were going to get there money one way or another. No you can not get it back, but if she has any other debts for child support or even outstanding tickets in some states as long as you put her social on your return your refunds or rebates or anything else-even property and savings accounts are fair game for them |

call the irs and ask then go after the x for the money in small claims court. |

im the girl you can never have

because our government is whacked up.
because ur married to her everything becomes equal...like access to a bank account...ever heard of the saying "whats mine is yours"? i know its not right, but like i said, our government is selfish and immature and its just..... |

You're married to her, whats hers is now yours!
My brother is going thru this same crap!
the government is only giving this money out because they know their going to get it back in the long run! |

hmmm, you should check into. If it was pre-marital debt I don't think they should be able to take your half of the check. |

No way can you get it back once they take it. Once the IRS decides there is a debt, they don't care how they aquire the funds to clear it, regardless of who the debt belonged to or on occasion how old the debt may be. |

community property or something like that. I don't think you will ever see that again. Maybe you could appeal it? Course to do that, you will prolly need a tax lawyer, and then that adds up quick. I feel bad for ya, I am hoping to see mine. I am one of the lucky ones who paid in, so I won't get mine till July I guess. Good luck. |
