Okay, Credit cards started coming in after my senior year of HIgh School.My parents and I decided that I would get 2 credit cards..and pay them every month.Well, I did that for a year.Next thing that I needed was a car.Well I got a really great car but the payments were more than what I could spend monthy.Well make the longer story short....I stopped paying my credit cards.It's almost 4,000 in deb.I cannot pay them.I am barely getting by.So...can they make me go to jail? I know my credit is gone...but can they take me to jail? No, you absolutely will not go to jail, send a cease and desist letter to your creditors if they are harassing you. If you are working and plan to pay back the money then just call a debt consolidation co. But if you are barely getting by and if you can take the 7 year hit and buy everything for cash upfront then what I would do is before youre credit goes really bad get another credit card with a 0 balance offer or low interest rate, transfer 2k from the 1st credit card that way If you dont pay the amounts will be lower and since they are different banks they will be charged off, Its less chance that they will come after you for 2k these are unsecured debts and they have to pay lawyer fees thats why on tv these lawyers always say "do you have more than 10,000 dls in debt" call us. it has to be worth their while and MONEY. I know its not the best advice or solution but you have to prioritizefirst. |

Every get credit, NO!!
They will get a judgement for the amount you owe. You don't have to pay this, but if you every want to by a house or car, etc, you will have to pay them.
Plus the lawyers fees, etc will add another $1000+ you owe.
I suggest that you start paying them off. Talk with the lawyer to see if you can get the interest to stop and set up a payment plan. |

I think the most they can do is seize and sell off all your assets (i.e that car you love so much) to settle the debt with your credit card companies.
I would suggest calling your credit card companies and offering them even five or ten dollars a month. It shows good faith and that you aren't ignoring them, you just cannot afford to pay the minimum right away. The more you ignore, the worse its going to get. They will understand and be grateful for any amount of money, even if its less than the minimum, and will get off your back until you can get back on your feet.

Don't worry. You absolutely will not go to jail. I assure you! The credit company will come after you though. Remember to deal only with the company that you borrowed from and not any collection agency. Most of those are crooked. Call the credit company and tell them that you will try to pay off your debt. but they have to stop charging you interest. Then, to show good faith, send them a few bucks every month until you are in a better financial situation . That should get the goons off your back. Don't worry; you can do it. 4 grand is not that much in the big scheme. You will eventually be debt free and hopefully remain that way by being disciplined.

Don't worry you will not go to jail.
The very worst thing that can happen is the collection company can sue you and get a judgment from the courts, at that point they can attach bank accounts, garnish wages (if your State allows it) and file liens on any property you may own like cars, boats, land and homes.
All of this activity will show on your credit for 7-years making it very hard to get any other types of loans without making massive down payment, paying huge fees and State maximum interest rates.
But at least you won't go to jail.
You should call Consumer Credit Counseling Services at 1-877-388-2227 they are the largest consumer credit counseling service in the Country and are non-profit.
I used them several years ago and thy lowered my monthly payments and interest rates, I was debt free in 36-months. |

No, there's no such thing as a "debtors' prison." Debt is a civil issue, not a criminal one--unless you committed fraud (falsified an application).
Don't be intimidated by collectors. In fact, I would tell them to stop calling you and correspond with letters. Collectors (even lawyers) will lie to you to get you to pay their bill first.
I would be proactive and call the credit card companies - explain the situation. Close the cards and make payment arrangements that you can work with. If they bully you, don't cave in. Just end the phone call and send them a letter with the same repayment plan offer.
The did the same exact thing 20 years ago and I was lied to and bullied by creditors all the time. I wish I knew then what I know now.
Also, make sure, above the credit cards, you keep that car payment current. A repo looks worse on a credit report than a charged off credit card.
It took a very long time for me to repair my credit, but it can be done.

No, you can not go to jail BUT - you need to take some action and soon! If an attorney called your house you DO need to call them back.
What can happen is the credit card company turned your debt over to an attorney to pursue civil action against you - sue you. If that happens and they are granted a judgment against you - they can garnish your wages at work, place a lien on any property you own, and even levy (take ALL your money) you checking and saving's accounts!
Try and set up a repayment plan. Unless your going to file for bankruptcy, you owe the money and need to start taking care of it. Not only could legal action be involved - the fees and finance charges are going to add up daily! Your balance can go from $4000 to $10,000 in no time!

Most people don't know that it is illegal or against the Fair Debt Collection Act for them to harrass you with phone calls. The Lawyer calling is a scare tactic and for most people it works. You won't go to jail, they will attempt to collect this debt for as long as it takes and if they don't get it they will charge off the debt and it will show up on your credit report as a charge off.
I have attached a page regarding this and what your rights are under the law, most states have additional laws that prevent consumers from being harrassed this way, but 99% of the population don't know this and therefore put up with the harrassing calls. The article also contains a sample letter that you should send to your credit card companies telling them to cease all contact with you in an effort to collect a debt, and trust me they will stop.
If you want to maintain any sort of semblence of good credit then I'd call your credit agencies and see if they are willing to work with you in either lowering your interest payment or eliminating the interest altogether. Most agencies don't want to write off the bad debt they want their money so they are willing to work with you paying or lowering your monthly payment in order to lower the debt.
Cut up your cards, remember, you only need ONE credit card that should be for emergencies only. Try and work it out with your credit agencies because if you dont' it will haunt you in the future, it will prevent you from getting a good job in any of the finance industries (banking, accounting etc) ruin your chances for buying a house (high interest rate need more money down) buying a car (very high interest rate) or even getting a line of credit with anyone. Take it from me, I've been there and had to file bankruptcy because I just couldn't handle the debt anymore. I refuse to own a credit card now, if I can't pay cash for it, I can't afford it.

Yes it has happened to me more than once, they are agencies out there (Consumer Credit Counselling) that will consolidate all your bills into one payment and contact your creditors and work out paying arrangements with them.
Most of the credit card companies or whatever will even drop the interest charges.
Go to Google and try typing in...debt consolidation agencies, but make sure you research them before you sign up, they are only supposed to charge you something like $10 a month to handle this for you.
