Will debt companies trace me?
as soon as i turned 18 everything went wrong.... now at the age of 27 i'm in debt and not able to pay a penny back i have 3 children and live with my partner in his house, he has the mortgage i don't think i'd get accepted astually i'm pretty sure i wont. Someone told me the other day that when i get married in august the debt companies wont be able to trace me as my name would have changed anyone know if this is true? i know it's not the best solution but there is no money spare at the end of the month to even start paying off my debts......

Actually, they can still trace you via your personal data like Date of Birth, etc. Also, when you apply for any credit, they ask for previous addresses if you've lived at your current address for less than 3 years, so am not sure how you would hide all this.

So maybe the best thing is not to apply for credit, and lay low for about 3 years. Or how about consulting a debt management company and working out a budget to repay loans, etc?

I have to tell you I have a similar situation, minus the children. Even if you get married your debt and debt collectors will follow you. Depending on your state law the debt may now be on your husband as well. I live in a community property state and that means the minute I got married my husband became responsible for part of my debt. Changing your name doesn't help. You need a new social security number. That is how your debt is tracked.

Yes, they can trace maiden names and may find you, depending on the level of debt owed. If it's lots of small amounts you owe to lots of places, although its a large amount to you in total, each company may decide the amounts are too small to spend money trying to trace you as its expensive to try and find someone.

Personally I would not recommend it but if you are in so much trouble then it may be worth going into voluntary bancruptcy. This will affect your credit for 5+ years but maybe the best thing in the long run.

Alternatively you could write to each person, telling them of your situation and saying you are considering bankcrupcy but as an alternative could they agree to freeze the debt, agree to not charging any more interest and in return you will pay an amount equal to X each month. You should work out before writing to them what X is, make sure its reasonalbly affordable, without getting into more debt. Even though this might be a small amount and might take 10 years to re-pay alot of companies will agree to this go with those to the alternative of you going bankrupt and them never receiving a penny.

What accountant says is good but I would say that due to divorce I was left in a tricky financial situation and have debts to pay.
I tried the letter writing approach she suggests but they were not willing to accept this from just me having written the letters this was bank and credit card company. They wanted a third party involved to prove I was going to pay!!
They advised me to contact the Consumer Credit Counselling service an independant body set up by assorted Finance people to show they are willing to help people in difficulty.
I can not fault them they are free of charge and go through all the options with you and take away all the stress. They dealt with the bank and credit people and any letters I get go to them. I am in a Debt Management plan and it will take me 14 years to pay off my debts but at least I am trying to do that and not running away. I havew a review every year and if I have any spare cash it goes towards my debts.

It must be very stressful for you and it wont go away you really need to sort this out for your health, does your partner know about your situation because if not you need to tell him. It will affect both of you when you marry. Best of luck to you all.

You will end up destroying your future husband's credit. They will trace you through your social security number, address, children etc. Once they find you and discover that you are married and now "own" a home, they will come after the house or put a lien on it. You cannot escape them. Your best bet is to start making payments even if it's only a few dollars a month. The interest continues to climb each month along with the late payment fees. So, say you start with a $1000 debt. In just a few years time it will be a $10,000 debt and you'll never get out from under it. You might want to consider filing bankruptcy before you get married so that your debts are gone before you get married and destroy your husband's credit.

you could go to your local county court and ask them for an accommodation order application form. fill it in and hand it in. you will be called before a friendly local solicitor who will say things like "you silly girl" and tell you to pay £2 a week, until you decide not to pay it... that's it nobody will come after you, in fact its against the law to pursue you under threat of some thing like £50000 fine. this is the little known law that the companies on the tv will charge you £1000's for. make sure you go to the county court not the high court or magistrates court.

You can get traced via electoral roll, applying for any type of credit, takingour insurance, filling in any official forms etc. The way to get out of it is to explain your situation to the crdit providers. don't tell them about your partner and sort this before you get married as your credit file will be joint if you apply for anything together.
If you go the the citizens advice bureau, they will give you an income expenditure forms (or you can call the lenders) which you allows you to state what money you have coming in and where you have outgoings. In most circumstances, banks will stop interest an charges and ask you to part settle.

They use a combination of things to trace people your last name, your address and your social security number.

If you apply for credit with your husband after you get married, they will find you.

As long as you keep everything in you husbands name until the statute of limitations run out, you should be OK.

That is unless you live in a community property State, if you do, your husband will be responsible for your debts as soon as you get married and could end up losing the house,
