In my experience it wont make a blind bit of difference they will tell you to go back to work .They arent interested in the facts they just want there money .I know its not nice to hear but it's the truth I've been there !!!

The only way to answer that is " IT DEPENDS " You need to make some phone calls and explain what has happened and make new payment arrangements, but you have to keep the new payment arrangements, or you will be in default of the agreement. And you need to let them know before you are in default of any current agreements

It depends on the type of debt your talking about, but mostly no. The reason being is that you had this debt prior to a disability. I would suggest you get your doctor to fill out a statement that you are disabled and not able to earn a wage. Contact everybody you owe and explain the situation. They may make different payment arrangements with you and in some cases may be able to discharge the debt depending on if you are permently disabled and can never earn a wage again. This is important......at least attempt to make payment arragments with them and send certified letters to each company with your Dr. statement and request that paperwork be sent to you for a disability discharge or new lower payment arragments. hope this helps good luck

No. If you have any assets they will try to collect from you regardless of your medical situation.

If you have very few assets and just your disability income, you may be judgment proof. Which assets are exempt from judgments varies from state to state.

If you feel you are judgment proof, let your creditors and the courts know.

but do check with them
some credit card companies have disability insurance where they will make the minimum payments while you are not working due to injury.
ask them about retroing you onto the program....all they can say is NO!

I doubt it. I know that if these creditors go so far as to issue a wage/income garnishment there are some forms of income that are exempt. As for calling and hastling you and demanding money, they pretty much have a right to do that whenever they want to. I mean, I think there are some basic rules for them, but I don't think they really care how get the money, just that you send it to them.

If it's social security disability I believe that may be exempt from garnishments, but if it's something else like, say, workers' comp or Aflac or any other private insurance payout, I think they can still garnish such income.

I'd do a search online and see what you can find.

You need to write to all of the people you owe money to and explain thoroughly your situation. With this you need to also include a detailed account of your income and expenditure (make sure this goes i your favour) and offer them a monthly payment. They may try and go for more but stick to your guns and if they refuse offer the same amount again (and send a months payment). They will accept no matter how small as the courts would accept that amount anyway so its not worth their while to take you there.

with regards to CCJ's, this is the same they take into account your income and expenditure when deciding how much you can pay.

So, in answer to your question your income is the deciding factor in people 'easing' up on you not the fact of your accident or what benefits you recieve.
