You can't go to jail and it's actually illegal if they threaten you with that or any other threat. You can, however, ruin your credit. I get calls from collection agencies all the time (thx to millions of hospital bills and such) and the worst they can do is continue to bug me. They are NOT allowed to call you more than 3 times in one day otherwise it is harassment and you can report them to the Better Business Bureau. After 7 years, it is automatically removed from your credit even if you haven't paid anything. Now don't use that as a reason to not pay, because your credit will still be scarred and bad credit is not helpful in this world...trust me...lol.
Anyways, if they continue to call you more than 3 times a day or threaten you OR call you after you've told them to stop calling, report them. You can not go to jail unless you owe the Federal Government money and even then you generally don't go to jail...they just take it out of your paycheck whatever you owe (which they can legally do...it happened to my husband when he messed up on his taxes a few years ago).
Anyways, hope this helps you...ohhh, and if you atleast make a small payment of like $5.00 each month then they HAVE to leave you alone because you are making payments, even if it's not the payments they want you to make. |

No, you won't go to jail.
Collection agencies buy your debt from the credit card company because the credit card company doesn't want to mess with you any more. In example, you owe capital one $2000 and capital one sold your debt to XYZ collection agency for $200. Anything they get from you over $200 is pure profit.
Once capital one turned your debt over to a collection agency you got a bad hit on your credit report. Paying off the collection agency won't help you at all - it was still debt that was turned over to a collection agency.
The only thing they could possibly do to you is try to get a judgement against you. They won't do it because it's much more expensive than what they paid for the loan.
When the collection agency calls you tell them that you're not going to pay them anything. They'll threaten you with all kinds of things, but it's all b.s.
They'll keep calling you and getting nastier and nastier, you can just hang up whenever they call or read the bible to whoever calls you until they hang up. |

no you will not go to jail. but your credit will be hurt. In addition, when Capital One turns the debt over to a collection agency, your costs will increase. You actually don't have to pay the debt off, but when you go for credit, like buying a house, etc, this will show up and you will have to pay it off (including the late fees and collection fees which could be triple what you owe) before they will give you credit.
Call Capital one and see if you can work out a payment plan without the interest each month. |

No you cant go to jail for that. Next time the creditors call you tell them that you require that they only contact you via mail. They have to do this it is part of their guidelines |

No, you will not go to jail. Next time they call, get an address for the company and mail them a letter stating that you will not accept phone calls from them concerning the debt and that any and all letters concerning this debt should be sent to your address. By law, at least in West Virginia, they cannot call you again after recieving the letter. It's also a good idea to send the letter with delivery confirmation so that you know 100% for sure that someone at the company had to sign for the letter. Also remember that when dealing with a debt collector, they must follow the laws of the state you live in and not the state that they are located in.

NO!!!! Don't let them bully you! You...BY LAW...have the RIGHT to tell them "DO NOT CALL ME AGAIN" and they HAVE to stop calling you. If they keep calling after that, look in the phone book for Consumer Affairs, in the Blue section. You have to pay, but not all the interest the collection agency charges. And, they can't do anything as long as you don't have a job. Once you do, pay them $5 a week or so and then they can't do anything to you. Pay your bills from now on though! |

You won't go to jail, but you should reconsider all the advice about ignoring them. This will follow you in life like a bad rash and when you decide to finally grow up and spend only what you can afford, you will have problems buying a house, a car, or any other type of loans. I suggest you call them and explain your situation a. What do have to loose? |

Just ignore them! The worst they can do is try and ruin your credit. I know a guy that gets calls from collection agencies everyday and he just puts them on ignore. He has been doing this for 10 years already. I told him he should just change his number. Good luck! |

I have been in this situation and here is what worked for me.
1. Make the collection agency PROVE in writing that they own the debt. The should be able to mail you something in writing that they own the debt, the original issuer of credit, your information, and your options.
2. Explain that you are unemployed and that you are seeking employment.
3. Offer to provide them updates on your job search and availability to pay the debt.
4. Make sure you speak to the manager only. Usually the ones calling you are not a manager and they have no room to bargain.
Above all do not argue on the phone. It serves no purpose and by Federal law they are limited by what they can say and do when collecting.

THE FAIR DEBT COLLECTION ACT
THE STATUE OF LIMITATIONS for your state.
Both of these will give you the information that is usefull |

No, you won't go to jail! As far as the collection agency calling you - if you want them to stop ... you can make them. Write them a cease and desist letter (demanding they cease & desist calling you) .. mail it return receipt (to a physical address - no P.O. boxes!) and watch the calls disappear! It's the law - they have no choice.
Don't forget, even if they stop calling you - you still owe the money. The longer you wait the more you'll owe because of finance charges and fees!! |
