Wondering, Can I get arrested for this? Or is this a Civil Matter?

i just wanna make sure the cops dont knock on my door.
I already did this, just want to double check.
To Make a long story short.

I have 2 accounts at a bank.

Each account had $5 each, I used my debit card and overdraw each account.

I had a $250 penalty on each account.

A total of $500

$500 wasted, like flushing it down the toilet.



So, I bring each account down to $6

Totaling $12.

I goto the ATM/MAC Machine and take out $500 cash each

I have $1000 cash in my hand.

Each account is -494 negitive $494, adding another $32 over draft fee.


I have $1000 of there money.

I tell them, I will not give you the $1000 back, until you refund my $500 in overdrafts i got last month.

Whats the worst, they can do? Put me in collections? My credit is already ruined.


This is just a senario, example, my situation was a little different, but im trying to give u an idea.

Can i be arrested?

This is a civil matter, right?

No, it's not a civil matter....it becomes bank fraud the minute you demand you fees back.

But they won't have you arrested, they will just keep adding (legitimate) fees and penalties to what you owe them. You agreed to all these terms when you signed the paperwork to open the account. You just didn't read the contract.

Actually when you demanded the $500.00 back before you would give them the $1000.00 it became extortion they may file criminal charges!!!

I'm not sure about "arrested," but I would seriously consider"committed," if you have this much trouble handling your money.My head spun while I was reading your question.Then my brain exploded.

First, they will contact you by phone or letter.
second, comes the threats, collections, etc.
Third, they may try to summon you to court and sue you.

This will go on your credit at least, they could try to garnish your wages or something to that nature. Beware!

You could always move to CANADA.

No they will just Charge you intrest for all the money you owe, so if you owe 1500 you will end up paying even more cause they will charge you intrest. so you would pay it back as quickly as possible or if you wait that 1500 will turn to 2000.

If the bank decides to report you for "Check Fraud," you can be arrested...

You owe them the money that your account is overdrawn, whether from your withdrawals or from fees. They can close your account and refer the amount to a collection agency, which will make your life miserable and they can put you on a banking industry blacklist so that you can't get a bank account, which will make your life miserable.

They might have waived the fees if this was your first time and you asked nicely, but your hostile attitude probably blew that opportunity.

Theft is theft, no matter in what form. Now it just depends on whether or not the bank thinks you're worth pursuing charges against, or if they'll just let the charges continue to mount until they're over the misdemeanor limit, at which time you could be in big trouble.

And your credit is not, necessarily, "already ruined." If you show good faith in wanting to be responsible, the bank could be lenient--they were with my daughter in a situation similar to the beginning of your scenario.

Eventually they can take you to court and sue you but that is probably is way in the future.

Until then no they cant do anything aside from call you 24/7 and annoy you.

It is the banks fault for letting you withdraw that much, therefore its on them....

i dont think you can be arrested because you didnt do anything against the law. but your credit will get pretty messed up and i think if it goes to collections later and the totlas get pumped up you can be sued, which could lead to going to court ect.
