You will not prevail. The credit bureaus database reflects what is reported to it. What agency is REPORTING this "erroneous" judgment? If the information really is incorrect, there are procedures to remedy that. |

You can't sue them. They ONLY report what is reported to THEM. Mistakes happen every day on credit reports. That is why it is YOUR responsibility to check your credit report EVERY year. YOU cost yourself that 1/2 point by not doing YOUR due diligence. The credit agency did nothing wrong.....YOU did. Sue yourself and take accountability for YOUR inaction's and quit trying to blame everyone else for YOUR screw up. Who gets a loan and does not check their credit WELL before applying for a loan anyways?? That is common sense. |

The above answer that blames the asker for incorrect information appearing on his or her credit report is incorrect on several counts. Under the Federal Credit Reporting Act, the federal law that regulates credit reporting agencies, furnishers of data to the credit reporting agencies must report accurate (Section 623(a)(1)), complete and updated information (Section 623(a)(2)) to the credit reporting agencies.
To the asker's point, the FCRA creates civil liability for failure to comply with the FCRA's provisions. See FCRA § 617. Civil liability for negligent noncompliance [15 U.S.C. § 1681o] If the credit reporting agencies were aware of the incorrect information and did not rectify the mistake, or acted negligently, they may have liability to a consumer who can prove damages.
Consult with an attorney in your state who has experience in consumer law. If you do not know of one in your area, see the National Association of Consumer Advocates (NACA) Web site to find one in your area. |
