Am I legally covered if my employer withholds money but doesn't pay insurance co?
I thought I signed up for the family dental plan at work 4 months ago. After my husband's dental claim was denied, I was told that I checked the wrong box (employee/child box) on my application. I did list my husband's name, his SS #, etc. in the list of covered dependents, but the insurance co. says they go by the box that was checked. My employer has been deducting the amount for the family plan from my paycheck. My employer just sent me a check for the difference between what was deducted from my paycheck for the family plan and the employee/child plan. I don't think this is fair, since my husband's dental bill is more than that. I think my HR rep dropped the ball by not catching the discrepancy on the application. She obviously knew I wanted the family plan since that is what is being withheld from my check every pay period. Evidently my employer is deducting for the family plan but only paying the insurance co. for employee/child coverage. How do I proceed?

Well, this is a fuzzy area. You're going to have to complain to your state insurance commissioner, in writing. And they'll ask for the insurance company to defend themselves. The insurance company will produce the application with the box checked, and I think that's going to be their defense.

I think the employer has fixed their error, by refunding you the additional amount.

I think you're going to have to wait until open enrollment, to get hubby signed up with the dental plan.

Unfortunately, I'm not sure there is anything that can be done about this.

You checked the box on the application for employee/child coverage, so technically that's what you applied for...employee/child coverage.

Most likely, the insurer never received the premium money for your husband. (When they send the bill to the employer, they base it on the number of covered lives that they show. So, I'm guessing that the employer just had the extra money in their own account vs. that they actually paid a premium to the insurer.) Since it was you who checked the wrong box vs. the employer or insurer not reading your application correctly, you'll have less of a leg to stand on.

Here's a big question though...why didn't anyone verify benefits *before* your husband had his dental services done? If someone (either you or the dental office) had made the call to the insurer to confirm your husband's benefits/coverage *before* any services were done, the error would have been discovered and you wouldn't be stuck with an unpaid dental bill.

This could be an oversight. I suggest that you have a meeting
with your employer to go over what you wanted and what was given.

If an employer makes a deduction for the benefit of the employee, in this case health insurance, they must have written permission to do so. The completed health insurance application gives employers authority to deduct amounts due for the health insurance. The fact that the wrong box was checked on the form means only that the insurance company was charging the lower rate to the company and only providing you with the lower coverage. If an administrative error occured, deducting more from your paycheck than the coverage you signed up for, then the company would be responsible for reimbursing you for the amount they deducted in excess of the correct amount. Its sounds as if they have already done that. If you still want coverage for your husband you can make a change on your enrollment however now you may have to wait until "open enrollment" before making any changes. You'd have to check with the Health Insurance Administrator. As far as the dental bill, most medical office have patients sign financial responsibility agreements stating that if insurance does not cover the bill the patient is responsible. It doesn't sound as if the insurance company will agree to pay that bill...You can check with an attorney if you like, but I doubt he'd say anything different. Just let it go.

I am with mbrcatz17 on this one. This is a boarderline area...

If I was your broker:

I would call the insurance company and seek an exception on your behalf. This exception would be unlikely because:

1. You fill out the application wrong.
2. HR didn't catch it on the premium invoices
3. You went 4 months without coverage & rendered services without verification of benefits.

In the likely event the above does not work...

You should seek remedies with the "Department of Labor" within your state. The Department of Insurance will have limited ability in your case as you filled out a form wrong that they approved as user friendly. The DOI will not require the carrier to pay for something they never received a premium. The Department of Labor will be able to address the issue of witholdings being taken out without coverage.

The best solution would be for you to find middle ground between you and the employer to pay the doctor. You both share the liability in the matter.

no you are not covered it the insurence company doesnt get your money then they wont cover you. you need to talk to your employer and let them know that the insurence has recived money and that is supost to get sent out.

This is not right. The insurance company is taking advantage of a loophole and your employer is a crook. Go to HR and tell them you need to have this straightened out. If they refuse to act, go to the insurance company.

The employer has been collecting the premiums so they are responsible for paying the claims. Don't cash the check and force them to pay the claim.
