Am I obligated to pay a collection agency?
I had an accident at school where my shoulder got dislocated. The school agreed to pay for all bills that pertained to that accident, and I signed a paper in which I agreed to only be responsible for a $25 deductable. I have now received two bills from collection agencies. One for the physician bill which is only $67, and another for the hospital which is $504. They say that the insurance has paid their part and that the rest is up to me. I called the insurance and they say that the one for the $67, they didn't pay that because the company went over the usual and customary which they dont take care of. And for the $504, they say that the hospital is in contract with some company that gives the insurance company a discount, and thats why they didn't pay for that amount, because it was suppose to be a discount. Anyway, am I really obligated now to pay for these two amounts? I don't even have the $67, I am a student and bearly even have money for gas. Can they sue me or something? You said that the school agreed to pay for all the bills that pertained to the accident. Did you get that in writing, signed by a legally competent school official? If so, then take the matter back to them and have them pay the bills they said they would pay! If they legally agreed to pay them, then they are required to do so!

Go to your school and present them with the bill. They probably don't even know that you are being billed this way. Most schools are self insured and use an administrator that handles the billing.

In the mean time contact the company that is after you, not the collection agency, and let them know what is going on. By law you DO NOT have to deal with the collection agency unless it bought your debt. When the agency calls you again let them know that your debt is in dispute. Again by law they cannot try to collect on a disputed debt nor can they report a disputed debt. BY LAW they must contact the people/companies that you are in dispute with and CANNOT attempt to collect the debt and, that includes contacting you, until the dispute is resolved.

Without seeing exactly what you signed with the school, it's difficult to give you an accurate answer. It probably states that they will only cover "reasonable and customary" which is usually not even close to "resonable and customary". Anyway, you will probably be responsible for that amount, unless you can take it directly to the school and inquire about them picking up that amount (not likely). Call the dr's office and see what arrangements can be made to make small payments. As for the $504, that amount sounds like it should be a contractual writeoff that the hospital missed, which happens frequently. To rectify that, it is best if you can get a copy of the Explanation of Benefits from the insurance company showing how it was paid. The discounted amount should be listed there. Call the hospital billing dept. and explain that a discount was missed and the account went to collection. If they need the EOB, you can fax it or mail it, possibly even take it in. Whatever you do, make sure you get the name and phone number of whoever you speak with and ask them to contact the collection agency to reverse the account. It is a good idea to get proof from the hospital that the account is a zero balance. After you get the proof that the account is zero, call the collection agency and ask them to take this off your credit report and get that in writing as well.

They might sue later, after you graduate and have money. If the school agreed to pay and did not pay, see if you can sue the school.

The key here is the term "collection agencies"

NO ,,you DO NOT have to pay them. You are only obligated to the original creditor,, the doctor and hospital..

Get the collectors out of the picture and then deal with the others.

I think it is called federal fair debt act,,

dont contact them, contact the doctors and the school. they need to settle it so it doesnt end up on your credit

some collection agencies have a department or person in charge of helping get insurance straight-- they may even help you get the school to pay up...they represent the doctors/ambulance/hospital ...whoever their client is, they need to collect for...they just want their money and they will figure out who is responsible or how to get it...i would locate an attorney before its too late (1yr??) and get a letter from the atty to the school along with copies of all medical bills...only because it seems like old debt can haunt you for a long time now that debt-buyers are out there: they buy up really old debt and put it on your credit bureau and just wait for you to pay (they get debt for pennies on the dollar) they can be a real pain!!!

If the insurance company has a contract with the hospital that they can only charge so much then the hospital can only charge that much and you are not responsible for the extra that is charged. I would try to get the EOB from the insurance company, that should tell you the amount that the hospital is allowed to charge for the treatment.
Do you have a copy of the contract you signed with the school? If so then you need to make a copy of that, send it to the collections agency and let them know that if they would like to collect the money that they need to contact the school and that you will have NO FURTHER dealings with them until they have contacted the school and straightened it out. Let them know that if they try to report this on your credit that you will pursue fraud charges because it is a debt that you do not owe.
They figure they will have an easier time getting the money from you then from the school. It is possible that they will continue this and take you to court. If they do then you will need to take a copy of the paper you signed into court and let the judge know that you sent a copy to the agency and told them to go after the school.
Hopefully they will back off before it goes to court, but if it goes to court then you have that paper to cover your butt. If they keep bothering you I would check and see if you qualify for ANY type of free legal aid, some lawyers will give you free advice in this situation also.

How old are you? If you are under 18 you are not responsible. If you are over 18, send the collection agency a letter demanding that they stop harassing you and tell them the institution that agreed to pay all of the bills. Eventually, they will go away.

One of the most dishonest business today are the collection agencies. They will do ANYTHING to get you to pay them anything. They will even produce a fictitious judges signature.
This is how they work: A company that says you owe them money and can't collect, will sell their list of payable to a collection agency for perhaps 25-40%. That way the company gets something. The collectors push you around until you get scared and pay them, with their false invoices, fake attorney charges, etc. The best thing I ever did was to learn this lesson. If you really want to loose them, change you phone number several times, and trash their letters to you. They will tire, and go after other weaker people.

Sure, the collection agency can sue you. Your deal with the doctors is legally seperate from your deal with the insurance company.

They'll win, hands down.

You need to call the hospital billing department, and ask them to reprice down to the contract amount.
