You just need to make sure to file the claim with the primary insurance company first, then file to the secondary w/a copy of the primary insurer's Explanation of Benefits.

(Primary and secondary are determined by industry standard Coordination of Benefit Rules...for example, if you're covered by your insurer and your spouse's insurer, your own policy will be primary for you. Your spouse's policy will be primary for him/her.)

And, of course, you have to make sure that both insurance companies are aware of each other. It would be fraud to file the same claim with both insurance companies as primary, if they aren't aware that there is another insurance company in the picture. (If you try to get away with that, you'll get caught eventually and they will come after you for the money. Even if its years down the road. And it will create a big time mess for you, as all the payments to all of your medical providers will be retracted for investigation, and your medical providers may try to come after you for the money in the meantime.)

There are no laws that govern this. If you have insurance with your employer, and also with your spouse, your insurance will be considered primary.

You need to be sure and give the info for both plans. The companies will do a "coordination of benefits" between the 2 of them. Usually, the secondary plan will pay what the primary plan did not. However, this depends on the verbiage of the policies.

Coordination of Benefits will vary depending on both carriers rules. Generally speaking their are two rules that you will need to become associated with:

1. 100% Allowable- This means that the secondary carrier will pay for the gaps between what the primary carrier didn't pay to the extent if they were primary. (Consistent with larger groups)

2. Maintaince of Benefits- This means that the secondary policies provisions are intended to uphold secondary benefits. In other words, they wont even consider a claim unless the claim was denied on the primary carrier. (Consistent with smaller groups)

Call both carriers and ask them which one of the coordination of benefits rules applies to each of the policies.

As for determining which one of your policies is primary...

1. Active/non-active rule: Your employer policy will always be primary over a cobra, individual and a policy you are covered as a dependent.

2. A policy without any COB rules will always be primary over one that doesn't have them.

When you file a claim, let them know you have other insurance and what they paid.
After the primary carrier pays their amount, you can file with th secondary for that the first co did not pay.
Now, who is primary?. If you have ins through work, yours is primary, and if your spouse also covers you under their plan, that is secondary.
There's no law against it. But you cannot recover more than 100% of your expenses.

Generally, only one plan will pay. You need to read the plan documents carefully to see to which plan you should submit your plan. Even if both plans pay something, you cannot collect more than your total cost and pocket the difference.

You can file the claim with both companies. One is your primary carrier & the other is secondary. File with your primary, they will pay their portion and file the rest with your secondary. What ever is left after that is your responsibility. Your doctor's office or whoever provided the service should be able to do this for you.

There's no LAW, but you'll have to read your health insurance contract. There are provisions in every policy about how they pay, when more than one policy applies.

You don't end up "double dipping", and you can't generally avoid your copays and deductibles (medicaid being the exception). What DOES end up happening regularly, is that neither company pays - they both say, let the other guy pay. And then YOU have to act as the intermediary, and get it straightened out.
