Right outside my house this morning there was a wreck. A guy ended up in the brushs. Well he said that our dog was in the road so he swerved to miss her and ended up in the trees. Nope, you are not liable. Unless he HIT the dog, and there's blood and fur, in which case you CAN be held liable for his damages.
Swerving to avoid something in the road, and having an accident because of that, is ALWAYS the swerving driver's fault. From a liability point of view, if you're the driver, you want to hit the animal in the road.
If I had a dollar for EVERYONE who said "I swerved to avoid the (insert animal here) in the road", I'd be a rich woman. In his case, it could be a pink elephant. |

You are right, you might have a legal liability issue. If you have homeowners or renters coverage do not worry, you will be covered. In most jurisdictions it is actually illegal to slow or swerve for an animal, so most likely you are fine, but the first answerer is correct a judge and jury decides if you pay not us. If you are worried, inform your homeowners or renters coverage on this and the personal liability will apply for the dog. |
