Are you required to cover your spouse?
For the state of NC if you have been separated for over a year and the divorce has been filed do you have to continue to carry your ex on your health ins? the ex is working and eligible to get ins from work and was only on mine b/c i was nice and he was to lazy to get and keep a job. Depends. What does the seperation agreement say? It should be spelled out there. Also, the divorce agreement should ALSO have provisions for insurance.

You are not required to put a spouse on your insurance. But in my workplace, I did have my spouse on my insurance and until the divorce was signed, sealed and delivered I wasn't able to remove him. Most insurance only let you change the specs (type of coverage, who is covered) once a year, except in instances of new child, divorce or marriage. As soon as you have the paperwork, you should be able to take him off, unless there is some sort of clause in the divorce that allows for him to stay on.

nope. I don't think you are required even if you are married. I am married and don't have coverage on my hubby.

This should be addressed in the court papers. See your attorney first! Generally, the courts will not allow you to substantially change anything to do with money, insurance, etc., until the actual divorce takes place.

You could try being nice and asking your stbx to sign up on his own and once he does, have him give you a copy of his insurance card.

If you work for a company with a knowledgeable HR staff, they won't allow you to just cancel his insurance. Insurance regulations won't allow it. You will either need proof of other coverage, or for your stbx to give you a notarized statement that he no longer wants the coverage.

As your employer and the insurance company could end up personally liable if they cancel without proper documentation and he gets cancer or something equally expensive.

As long as he understands he is not on your policy, it should be fine. Make sure he has enough time to tell his employer to add him to their insurance.

No, Even if the divorce has not been filed you do not have to carry him. Girl I would have cancel him off mine a long time ago!
