Tuesday morning i hit an car that ran a light. There was a witness that i had had the green light and i wasnt blamed for the crash. this women had no insurance and no licence. My car is totaled as is hers. My insurance does not have uninsured motorist. i cant find a lawyer that will go after this ladie to pay off my car and visit to the ER. any suggestions? My insurance is only paying the value of my car. I live in TX. |

Ah, it's not that a lawyer won't take this - it's that they won't take it on CONTINGENCY. If you pay them up front, they'll take it. That's because, they think (and so do I) that even if you win in court, and you will, all you'll get is a judgement that this woman won't pay.
Best bet, if you don't want to plunk down some serious cash to hire a lawyer, is to sue her in small claims court for your injuries, up to the maximum - which I believe is $7500 in TX. |

Call your local small claims court and ask about the maximum amount you can sue for there. If the amount you want to get from her is under the limit, sue her there - you won't need a lawyer. |

If your insurance company is going to fix your car then you must at least have collision coverage.
Take the other party (she's not a lady for what she did) to small claims court for your medical bills and your deductible.
Make sure you take a letter from your insurance company to court with you saying you were not at fault. Get a letter from your insurance company.

I love how people assume that some lawyer would take the case. They won't b/c they know that they will never collect the money. She is uninsured, so she probably has no assets and no job and is judgment proof. Also, from the sound of it, you are not injured and would only receive a minimal judgement.
Your best bet is to find a collection attorney. You can go to NARCA's web site (North American RetailCredit Attorney Assoc.) to find a collection attorney near you. They will do a quick search for assets and employment and know off the bat whether she is judgment proof.
Also, this is why you carry um/sum insurance. You should get as much of it as they will sell you. What if you had broken your neck in this accident. With UM/SUM, you go to your own insurance company. I carry a $1million policy just so that I can get that amount in UM/SUM. |

This happened to me 2 years ago. If you sue her you will get a judgment in your favor and that's it. NO cash.
In Texas it is estimated 32% of drivers have NO insurance. Scary.
Get some good insurance from Landa. They are in Texas. Full coverage with under-insured/uninsured coverage will cost you about $60 a month. It's good piece of mind.
