Auto accident, other driver at fault?
Was in an accident where the other driver ran a stop sign and hit me. He admitted it was his fault and my insurance is assigning 100% liability to him. I drive an older car that I bought used and the damage will probably exceed its value so I'm assuming they will say its totaled. How much should I expect to get? Can his insurance pay me less than what I paid for the car? What if I disagree with their offer?

You will get the Actual Cash Value for your vehicle. Most insurance companies do not use the Blue Book, Red Book or Kelley's. They use third party companies like Certified Collateral Corporation which determine the value of your vehicle based on the local market. So, yes, you might get less than what you paid for the vehicle. When the offer is made, and if you disagree, go over the options that were used to evaluate the vehicle, and make sure they have the correct mileage. What was the condition of the vehicle......Excellent, Good, Fair or Poor? If you cannot agree, then most policies have an Arbitration clause. You, your appraiser and an independent decide on the value of the vehicle. Good Luck.

If the car is now more used then when you bought it, giving you what you paid would be letting you benefit from the accident. You would have gotten to use the car for free. Suppose someone had a 20-year-old that they had bought new and were amount to junk (for nothing) when someone hit it, so they got reimbursed for what it cost new?

If you disagree with their offer, you do not accept the offer. Then you sue them.

You will get "actual cash value", nothing more. That is the way insurance works. It doesn't matter what you paid for it way back when.

It's not the company's fault if 1. you paid too much for the vehicle, or 2. you still owe more than the vehicle's worth. They should pay you the actual cash value of the vehicle plus sales tax and title fees.

If you disagree on a value, you don't have to accept the offer, but in my opinion, 90% of insurance companies pay fair amounts for vehilces. Most of the time the confusion happens because people have an unrealistic view of the condition of their vehicle. It's NOT the only one that was ever made and it's NOT in excellent condition. If you go to nada.com or kbb.com to get a value, make sure you rate it as a private party sale in average condition.

P.S.- If there was old damage that was on the car before the accident, be prepared for them to deduct for it. It's legal, and a common practice.

You get actual cash value for your car - what it was worth, one minute before the accident. You can get the value from www.kbb.com, be sure to be honest about the condition and any old body damage, and use the private party sale value.

His insurance company isn't responsible for what YOU paid for the car. If you paid $100,000 for a $2,000 car, that's YOUR problem. They pay actual cash value.

If you disagree, you refuse the offer, and you take him to court. Then you have to prove to a judge, why the actual cash value of the car is more than they offered. That's STILL all they are responsible for.

Most companies will give you blue book value on the car. So if the blue book value is less than what you paid then yes....you will get less.

All you will get is the value of the car, on todays market, it does not matter what you paid for it. Insurance is a scam.
