Bought a car for a friend.She quit paying the payments and insurance.She is parking it getting tickets etc etc
It is 100% in my name ,she is not on the loan or insurance in any way.(I know im a sucker).So now she says its her car and I have no say because she made the down payment,cash no contract. Im going to pay the payment this month I always keep it current.My question is if she wont return it can I report it stolen?I'm in California.Thanks guys any info would be great.

If I woke up in your shoes, I would take my d*mned car back!! I would take it back, pay the tickets and get it current on it's payments and sell the S.O.B.

You can report it stolen if you physically get in contact with her and let her know that it needs to be at your house at a certain date and time...and she still doesn't bring it back. It wouldn't hurt to record the conversation with a dictaphone either, just so you have proof. If she returns it and has done some vandlism, I would call the police in a second.

If she b*tches about losing her down payment, let her know that you were also out some money to pay tickets and make monthly payments.

It's YOUR car, go get it back!!

learn from the experience , accept the $$$$ loss , don`t do it again for any-body and , most Importantly......LOSE the (!) friend....you don`t need people like that in your Life..!

and yes , report it as stolen and if friend argues , say it was a loaner , until friend could get self set-up with own transport and let friend take you to Court.....after all if friend loses , friend pays Court Costs...be brave!

and you can do an Affadavit to state that you loaned the car and theere-fore can`t be responsible for the Tickets accumulated.

You are the LEGAL owner of the vehicle and therefore responsible for any action that car does which includes accidents it causes. If the tickets are not being cited to her name but to the license tag, then you are on the hook for them too unless you can prove expressly that you were not the operator of the car at the time of the violations. You need to get that car back. You cannot necessarily report it "stolen" as she has the keys. However, you can request assistance for getting the car back.

Contact PD first and explain you legally own a vehicle that you had given permission to another driver to use the vehicle, but now has refused to return the car back. Proof of the car registration, insurance papers, and loan papers will most assuredly have the legal proof of ownership. There is no need to explain the original "arrangement" since again everything is legally in your name. That is a pointless part of the situation.

I'm sorry, but that is the dumbest thing I've heard....you can't report it stolen if it really isn't. you'll be charged with filing a false report. if it's in your name only, then it's YOUR car. where the hell is she? get the bank to repo. your credit will be screwed, but it's your fault for buying it.

No offense - you are a very big sucker.

In the eyes of the law - the person whose name is on the title is the owner. REPEAT: NAME ON THE FRONT OF THE TITLE.

It does not matter who made the down payment- it does not matter if her name is on the insurance policy or even on the registration. THE TITLE is the ownership document.

If your name is on the title SHE CAN NOT report the car stolen - she does not own it.

Now....since your name is on the title - the city/state will come after YOU for the parking tickets the car got. If any tow charges are accrued on the vehicle YOU are responsible for them. If your name is the only one on the loan... the bank will come after YOU for repayment and YOUR credit will tank.

Since you are on the title as the owner - if she has a wreck and hurts someone - the injured person can sue her (since she was driving) and YOU because you are the owner of the vehicle.

Here's the kicker....since her name is not on any of the documents....it will in no way shape or form affect her. She gets to walk away scott free. You would have to sue her and actually collect on the judgment to get any money back.

And...since the car is provided for her regular use and she is not listed on the insurance "in any way" - If she has a wreck in the car -- the insurance company CAN void the policy. That means NO COVERAGE for the accident. Which means YOU will have to be financially responsible for the damage to the car - continuing to pay the car note (if a total) and can be sued for damages and injuries for the other parties. So at the very least.....call your agent and list her as a driver on the policy. You do not have to list her as a "named insured" but if you want insurance protection while she is driving that car - you have to list her as a driver on the policy.

Here's my advice - get YOUR car back. Let her purchase the car from you and put the title in her name.

And one more piece of advice....never never never do something like this again. It's your financial future that is at risk...not hers!

Get the car back now! If she won't give the keys back then threaten to call the police, however don't report it stolen. If she tries to call your bluff then call the police right there and then.
