Bought a home 2 years ago damage to the home was not disclosed?
A family member purchased a home 2 yrs ago. On Christmas Eve 2008, their home flooded it now has over 11,000.00 of damage. As they were talking to a neighbor the neighbor disclosed that the same thing had happen to the previous owners which lived there for 6 years. When the insurance came out they told them it was a grading problem caused by the builder and this would continue to happen. My questions is, isn't it against the law not to disclose when selling your home that there has been damage to it? If so, what do you recommend they do? Who do they pursue the bank, realtor or the previous owners? What can they do about it?

In most states, if not all, disclosure of such damage (to the structure) is not required, as long as appropriate and full repairs have been performed and completed. The grading issue should have been obvious to a home inspector/engineer, had your family member properly engaged the services of such a professional. The bank has nothing to do with this, nor does the REALTOR involved (the realtor isn't a professional inspector). The former owners may not have known that their flood was caused by such grading issues.

My guess is that there may be NO ONE culpable in this situation. Your family member will have to somehow prove negligence and/or fraud intent to get anywhere on this one.

terribly sorry to say, but i think it's buyer beware, nobody has to tell you anything.
if you had hired an independent inspector, there may be some action to take against them not finding and disclosing the damage to you.
the fha inspectors only look for the basics and won't really tell you anything.
there is no law of disclosure that i'm aware of regarding your case.
you may have a case against the builder depending upon the age of the house. if the house is only 6 years old, it may fall under the statute of limitations and still hold the builder liable for improper drainage/grading. the builder would then hold the excavator in liability. however, it may also be a city/county inspection issue as it is ultimately up to the building inspectors to ensure that the property grade is sufficient for appropriate drainage prior to issuance of occupancy permit.
i hope this information will be helpful but, sorry, i don't think there are any laws of disclosure regarding your case.

No, repaired damage need not be disclosed. Defects, if known, must be disclosed. I'm not sure that flooding would qualify as a "construction defect."

You should always get a home inspection before buying a home,that way you always know what's going on.The inspector looks for everything that might be wrong .They need to see an attorney.

That's called fraud. The statute of limitations on fraud is two years. It could also possibly constitute breach of contract, for which the statute of limitations is four years. The previous owners are obvious defendants. The realtor also is one, and if he/she knew about it, she's liable. What do you do? That's tough, because it would cost way more than $11,000 in attorney fees to sue. You might try suing in small claims court. It would limit your damages, but I don't see any other reasonable option. Is it covered by insurance?
