COBRA Fraud?
My husband voluntarily left his company last Oct. We have been paying the COBRA since then but the company will not release the payment updates to the insurance company and we have been without insurance since then. I have already involved the Dept of Labor and the company (Nuvox Communications) just lied to the fed and told him everything would be released. My husband is diabetic and my toddler has epilepsy. What options do I have now?

Get an attorney, #1. File a complaint with the state insurance commissioner's office, #2. Keep calling the department of labor #3. You have a legitimate complaint and I would definitely sue your ex-employer for the grief they are causing you. The problem is with the ex-employer, not the insurance company. COBRA is an employer law, not an insurance law.

Go back to the department of labor and have them follow-up. I f that doesn't get you anywhere find a good labor attorney and sue the company. If everything is in order the insurance company would pay the bills. If the company did not handle the cobra properly they would be liable for the bills.

Contact your local Congressperson (State and Federal). They often have resources to help you. Especially if you can prove your claims are right. We had to do that with my mom's stuff and after they lied to his office they nailed the insurance.

www.diabetes.org. I saw on their website that they offer assistance to diabetic patients. or they had links to webpages who do offer assistance. Pfizer also will give patients assistance/free drugs if they are taking their drugs check their formulary list www.pfizer.com. Then check google to see if you can join in an existing Lawsuit against Nuvox. or get a lawyer and fight it yourself. If you schedule an appointment with a lawyer and tell them what you are up against they will have helpful advise of what to do next or where to go next for free. Naturally if you need their service they will make you pay but sometimes just being routed is enough.

If you're not gaining any ground with the labor department, try calling your cobra administrator. Ask for a supervisor, and keep going up the chain until you get an answer. See if there's a way for the COBRA administrator to help you fix it. They might be able to keep the policy open, if you get them proof of payment, monthly... Instead of terminating it each month. *shrug*

Also, speak with your doctors. Most doctor's offices know that COBRA can be a huge pain. They know you don't have any control over anything, except, paying your premium. They're usually understanding. Maybe they'll see you, and file claims to the insurance at a later date.


The insurance company probably won't be much help.

get a good lawyer and sue them, sorry to say that if you have gone through all of this so far without result, you are not left with many "polite" options

My daughter has been paying Cobra Payments since September 2010, the Cobra administrator has not released these payments to the insurance company as of today 2-1-11. I have called and the cobra administrator, a private company, said they are looking into to it, I called them back x's 2 today and got the response, "She's on the phone," so I left a voice mail, she hasn't called back. They have all the money from Sept. thru Feb, and no insurance. Do I need a lawyer? I have all the cancelled checks, so I know they have the money. Do you know a good labor lawyer in Spokane, Washington?
