Dad bought Tahoe at GMAC, they (dealer, who he's known for 30 years) knowingly new he had all the conditions listed on application, but still let him apply anyway. Dad passed 8/09/06, so now credit life sends forms wanting to know all health problems. If had none of the problems, then car would be paid off, otherwise my mother will get back the $2,220 the price of policy. Somehow shouldn't GMAC have fraud charges on them or some kind of consequence. Besides the dealer, the financial person also knew that he had all the illnesses. How can they let someone apply, knowing if they have any of the illnesses they will be denied and if they answer no to illnesses and credit life wants a medical history on applicant, which then applicant can get charged with fraud. |

Honey, the guy who committed the fraud seems to have been your father. I'm sure they have his signature on the paper explaining the conditions of the policy.
The problem is, they can't NOT let someone apply, that's unfair discrimination. The sales guy at the dealer is NOT a doctor, is NOT allowed to diagnose conditions, is NOT allowed to make health judgements on your dad.

The dealer will probably get his hand slapped, but that won't help your situation at all. Your dad would have needed to sign the paperwork, verifying the truthfulness of the application. If he didn't sign it, then it's not a valid contract anyway.
I'm sorry to hear of your situation. Did you dad have any other life insurance your family can use? (Insurance company, work, bank, etc.?) |

Ok GMAC dod not do fraud, the person at the dealer ship did the fruad and your dad ( sorry) signed the application, saying he did not have these things. So the dealership along with your dad did the fraud. GMAC does not underwrite these policies. Now that they have a claim, they got some of the medical info showing he had things, he said he did not have on the application.
So if he lied ( dealer ship lied) on the application you merley get the money you paid in ( and honestly not sure they would have to do that since the application for insurance was a fraud.
The dealership was trying to help you dad I assume not thinking he would die of course and they would get thier commission for selling the policey.
but in the end it is the person who is signing the applicatin to be sure he is always telling the truth. |

I see what you are saying, kind of. But, applying for credit life is an individual decision. Your dad had to fill the form and sign it, not the dealer or the financial manager. Are you saying the dealer filled the application for your dad and not disclosing he had conditions? Were you there to see what happened? You should talk to the dealer first and see what happened. Maybe he can buy the truck back at a good deal (for your mom). |

Might be a good question for an attorney. Were there witnesses that saw how the application was completed and how the questions were asked. Insurance agents can be held liable if they submit an application knowingly with false answers to health questions. Legal issues should only be answered by lawyers and a good one might can get your mother the Tahoe by threating a lawsuit. Just for thought. |
