Can I cancel my workers comp?
I need surgery for my knee. I injured it at work. I filed for workers comp to cover it, but I want it done as soon as possible, and I hear workers comp takes a long time to go through. Can I have it covered through my own insurance, and cancel the claim?

~~Don't cancel the claims. You have no idea what the future medical will be, if the surgery will be successful, etc. It does not take that long for approval for surgeries. It works the same as any managed care insurance works.

Have your doctor press the urgency for the surgery. He can help get ti through quicker. Any time you have a surgery, there can be all sorts of complications as well as successes. You need to protect yourself and your future, and keep it under the WC claim. Just be sure you remind your doctor daily if you need too, of the importance of getting this done asap.

Plan on physical therapy to go with it. Also if you cancel the claim, you can't draw much in benefits, so you will be out of your salary also.~~

workmans comp doesn't cost YOU anything - the insurance company covers 100% of the charges - if you were hurt at work, you MUST use the wkmns comp - it doesn;t take that long to go thru. Wkmans comp also pays you for being out of work - if you cancel the claim - you lose that income


A decent answer
Sure you can cancel it, it's called withdraw of a claim. It means that you will be responsible for your own bills and that work comp won't pay for a single dime of the claim including payments. Call your adjuster and tell them you want to withdrawal it.

But if the injury occurred at work and your bosses don't question it than your going to lose out on some impairment ratings later on. You can opt for surgery and put your personal insurance on notice. If they said go for the surgery than go for it, they will pay the bills and such. However once your claim is accepted than they will let the work comp insurance adjuster know that they paid for the surgery and that they would request reimbursement.

Remember your risking a lot by withdrawing your claim. Normally people get impairment ratings for surgery. Also what happens if you lost time from work? Who will pay you while your off work if you went private insurance? Not your private insurance unless you have supplemental insurance.

So you have the option on what you want to do, but if the claim is legit than keep the claim open. Also state laws give the adjuster 10-60 days to accept the claim, depending on the state.

You don't want to do that. Work comp will continue to pay most of your salary to you while you're off work. They will pay all of your medical for this for as long as you need. I had a worker shoulder almost 2 years ago. I've had 3 surgeries, the last one I had to have my shoulder replaced. I lost my job a year ago and I continue to receive work comp payments. My surgery didn't take long at all. I didn't have to see one of their doctors until after my surgery. If the surgery needs to be done, they shouldn't hold it up. I waited longer to get the results of the MRI than I did the surgery. Good luck.

Not true, about the workers comp.

You can't cancel a workers comp claim once you start. Or rather, if you DO, they don't EVER have to pay again, in many states - and your HEALTH insurance likely won't pay, either.

You're best off just getting the surgery done, then letting your health insurance go after the workers comp for it - NOT cancelling the workrs comp claim.

Do not cancel the claim. Get your knee treated, and have your own insurance pay to get it treated immediately. When the worker's comp claim is approved, any money for medical expenses already paid by your insurance will go to reimburse your insurance company, but any other money, such as for having missed work or for pain and suffering, will go to you.
