You won't qualify for any individual policies.
If eligible, COBRA would be your best option. (Divorce would be a COBRA eligible event...if your husband works for an employer that is required to offer COBRA.)
Otherwise, you'd have to look into high risk policies in your state. Those plans are required to take everyone, but be forewarned that the premiums are extremely expensive. In my state, a high risk policy costs more than $2,500 a month just for the premium alone. (And you still have deductibles after that.)
The only other thing I'd suggest to you is to look into your state's Medicaid plan to see if you'll be low-income enough after your divorce.
And, finally, there is always the option of getting a job that comes with health insurance benefits. A group plan would be required to accept you. This is really the "best" option available to you, because a group plan would have the most reasonable premiums. COBRA and high risk plans are extremely expensive. |

If you live in one of the 5 states that has guaranteed issue health insurance all you have to do is come up with the money and sign up. If you live in one of the other 45 states you are going to be ineligible for several years at least. Your options are going to be Cobra, state run high insurance pools, and employer sponsored (group) plans.

The person who stated "stay separated and wait to finalize the divorce" is on to something. he has to keep you on as long as you are married. Being that you've had a history w/ cancer, I wouldn't be in any rush to legally sever your relationship until you can find a job that offers group health coverage.
You have no guarantee he will be forced to pay. The cost of COBRA is outrageous and the more health insurance costs he has to pay for you, the less money there will be for spousal or child support (if applicable). You really need to get with your attorney and get a plan together because you will not find your own individual health policy.

An individual policy-no. But you would be eligible for COBRA (which could be court ordered to be paid by your ex-husband). This would at least give you 18 months to find a group based coverage.
Most individual policies will ask for medical records back 5 years for pre-existing conditions. |

Listen to your attorney on the decree.
You are eligible for 36 months COBRA continuation due to divorce. And you can add that to the decree, saying he has to give you the monthly amount. But make sure there is something in there regarding the annual premium increases. |

Likely not.
IF You live in a guaranteed issue state, like NJ, where an insurance company HAS to cover you, and HAS to cover cancer related stuff, they will likely price the policy out of your reach - like $5,000 a month. OR, maybe you live in a state with a "high risk health insurance" policy available - where you pay 2X to 5X the going rate (which would depend on your age), and the preexisting conditions are excluded for the first 18 months.
You didn't put in enough information for a REAL answer, but you should talk to a LOCAL health insurance agent, before you do anything. Or have your lawyer do it.
As soon as the divorce is finalized, you won't qualify for his group coverage any more. Even if a judge says he has to keep you, the insurance company does NOT have to keep you. But you could get COBRA, maybe, off his policy - at your cost - for up to 18 months. |

You should listen to your attorney. He knows the rules better than anyone.
If not you can apply for the state's medi-cal health welfare insurance.
Or, why not stay married and just separated?
