My husband was recently diagnosed with testicular cancer and we no longer are able to to afford medical bills on top of our rent payment. Is there any way that we can medically get out of year lease, which is up April 09. We need our deposit back as well... to pay medical bills. Any suggestions?? |

I'm sorry to hear about your husband.
There is no clause in leases that allow you to break the lease because of a medical condition. Like others have suggested you can certainly appeal to the landlord and ask them to let you break the lease. You may have one compassionate enough to may allow it.
But that wouldn't come without penalties. You'd likely forfeit your deposit, and most will also make you pay for any time the apartment is vacant before they are able to secure a new renter. But if they agree to let you out of the lease and you meet their conditions then at least you won't screw up your credit - which could make it much harder to rent, buy a car, etc. when your husband's health and your finances improve.
I'm sure you'd save money living elsewhere (living with a friend or parent, I'm assuming), but perhaps you could get the medical providers to allow you to go on a payment plan that could keep those payments affordable so you can also afford your lease. If you are paying cash rates instead of having medical insurance you can also negotiate what they are charging you and save a lot of money that way.

That isn't going to let you out of your lease with no penalties.
Best bet is to call the rental office, and throw yourselves on their mercy.
You won't get that deposit back, though, until after you've vacated, and they've established that you don't have any damages. |

unless the cancer was caused by the living conditions i dont think you can break the lease..
you may want to try explaining your situation to your landlord and maybe they will let you out of the lease but chances are you wont get your deposit back..
unfortunately its not the landlords fault that your husband got sick...so if they let you out of the lease i would b happy with that..

§6010-A. Landlord's duty to mitigate
1. Scope of section. If a tenant unjustifiably moves from the premises prior to the effective date for termination of his tenancy and defaults in payment of rent, or if the tenant is removed for failure to pay rent or any other breach of a lease, the landlord may recover rent and damages except amounts which he could mitigate in accordance with this section, unless he has expressly agreed to accept a surrender of the premises and end the tenant's liability. Except as the context may indicate otherwise, this section applies to the liability of a tenant under a lease, a periodic tenant or an assignee of either.

Well 1st of all where are u gonna live it is winter! Income taxes are around the corner and if u work then H&R block gives u an advance on ur return. I dont think any land lord is gonna keep u in a place if u r unable to pay, he is losing money and he could fill that spot with someone who has the money. Try 4 some state aid help there are agancies that help and he will qualify for disability/unemployment. I dont think he will give ur deposit back because u didnt stay a year. Some land lords are cool so I would talk to him and tell him what is goin on, he may be cool about it where u r being up front.
