Probably not. Did another car hit you? If that's the case then be friends with Wal-Mart. If not too much time has passed, you can ask for the security tapes for that day and Wal-Mart and the cops can help find who did it.
If you don't know what happened, chances are you're stuck paying the bill. I hope a judge and jury would see that, too. We take risks leaving the house everyday, just b/c it was at Wal-mart doesn't mean they did it. They have very good lawyers, too, so be careful or you could end up paying a lot more than it was worth to fix your car. |

SURe you can go after them - but you'll lose. They AREN'T responsible for someone else's driving. No court in the US is going to hold the store responsible for PARKING LOT CAR ACCIDENTS.
Just like, if someone comes to visit you, and they're in a car accident outside your house, do YOU expect to foot the bill for everyone's damages?? Of course not!! |

It all comes down to negligence - Wal-Mart has to have done something or failed to take reasonable action to prevent the damage.
Did Wal-Mart cause another car to hit yours? No.
Just because they own the property does not mean they are responsible for anything that happens to your car.
For example: a friend of yours parks ain your driveway. A tornado wind blows through and brings down a perfectly healthy tree from your yard onto your friends car. Do you owe your friend for the damage to the car just because you own the tree?
If the tree was healthy -no. It is reasonable to have healthy trees in your yard.
If the tree was dead/dying - yes. At this point you are negligent as a property owner - you had a dead/dying tree in your yard - it is reasonable to assume that a dead/dying tree is a hazard for falling down and by not having the dead/dying tree taken down you are negligent. Therefore, because of your negligence (failure to remove the dead/dying tree) you are responsible for the friends car. |

I used to work for WalMart so I can answer this. If you were hit by another car then No Walmart is not liable for anything. It doesn't matter if it happened in their parking lot or not.However if one of their carts hit your car and you reported it when it happened, then they will pay for the damages. |

Sure you can. Just like anyone who parked in your driveway can sue you if a tractor trailer veers off the road and smashes up their car.
The fact is, in America, you can sue anyone for anything if you're willing and you can find an attorney who will take your case. In most (not all) states, you'll have to meet some kind of standard to prove you have a reasonable claim before it would ever go very far, though.
On the other hand, this kind of mentality is exactly why all of us pay a fortune for our goods and services, as well as our insurance premiums.
Deal with the fact that you assume SOME responsibility for your own freakin' choices (like taking your car out of your locked bunker and daring to park it in a public place.) |

My guess is that it would be hard to get Walmart to pay unless you could prove that they were somehow at fault. e.g. it was icy and they didn't salt the parking lot, it was at night and their lights were not working to light the lot, you were hit by the Walmart security car. These are really stretches - in most cases they would have no responsibility. If you don't know who hit you then you might be able to collect on your auto insurance. Be careful because if it is only a dent or scratch you may report it and find out that the repair cost doesn't equal you deductible (most policies you pay the first $500 or $ 1000. |
