terry | Can I receive benefits from my ex? |
I was married for over 20 years before my divorce. My ex husband is 58 years old, and is not retired. However, he does receive a disability check from the government. I know that I can receive social security benefits from his account, but can I receive any of his disability benefits? My first inclination is no, but I want to be sure, with my tight budget, every little bit would help! Thanks for your time! Additional Details To all the people out there who are offended in some way by me question...
This man WORKS still, my father gave us the money to start the business he still has! He has the house, the business. I didn't ask for alimony or child support! All I wanted was out and away from his miserable self! I took care of him when he was sick, didn't leave til he was pronounced well from the doctors! I cleaned his house, cooked his meals, birthed his sons, raised them. Bathed him, dressed him when he was down and hurt, consoled him when cried, and still everything that went wrong in his life was my fault! So judge me if you will, I pay taxes every year, I have never asked for government assistance, no food stamps or welfare. Why shouldn't I benefit some financially if I can? I would rather not, but I haven't had a raise in five years, because my health insurance goes up every year and I can't give that up........... |

If he is receiving SSDI, no you are not entitled to any of his benefits.
If he begins getting SSI and medicare though, you could be entitled to recieve a portion of those. |

You're trying to cash in on your ex-husband's disability? That's pretty pathetic. He's the one who is disabled, not you. Whether or not you *can*, I don't think it's ethical. |

Yoy can not receiv any portion of his disability because you are divorced. This issue should have been worked out when you filed for divorce. If you wanted any portion of his pension etc you should have stated such when you filed for divorce. ITS TO LATE. |
