My mother divorced my father when I was 3 and remarried when I was 5. My step dad adopted me, so my biological dad lost all rights and guardianship to me. He subsequently moved to New York. When I was 17 1/2 I graduated high school and came up here to New York to live with him. I am NOT a New York resident. I still have my car insurance registered with Florida, I still have Florida plates on my car, I still have a Florida license, and I still receive mail at my mom and adoptive dad's house in Florida. So I am NOT a New York resident. I am simply up here on an "extended vacation." I will be returning to Florida within 2 years probably. The thing is my 18th birthday was in May of this year, so as soon as I turned 18 my mom said I could no longer be covered by her health insurance. I was like, "All my friends are still covered by their parent's insurance", but she said that I moved out of state so I can't be covered...that I need to get my own insurance. I was like, "What about people who go out of state for college?" And she said that they are only allowed to stay covered because they are college students. She says she can't claim me, and since she can't claim me she can't keep me covered. I think this is bullsh*t, and that she is just trying to make things hard on me. I am not claiming myself, my bio dad is not claiming me, so why CAN'T she claim me??? And then why can't she cover me??? I read somewhere that as long as I am still dependant on my parents, they can still keep me insured. Is this true or false? Because even though she ISN'T actually supporting me (I've been supporting myself)...I still am not claiming myself so she could claim me.
Please answer this only if you know. Additional Details Hmmm...this isn't looking good lol. Damn, I really didn't wanna have to drop 5, 6 hundred bucks every 6 months for my own insurance like my mom was saying I would have to start doing. Oh well. So new question...anyone suggest a good company to go with? |

Find an insurance broker in NY, and give them a call. Since you're young and healthy, you should be able to get an individual policy for $100+ a month. These policies DO NOT cover pregnancy, so don't make any plans in that direction.
The broker will be able to get you quotes from many different carriers and will help you choose the best one for you. This is a free service to you, the insurance companies pay the broker fee.

Once you turn 18, you are on your own, and need to get your own individual policy.
The only way around it is if you are a fulltime college student away, where you can be covered, but still you need to be in network.
When you are out of state, you will be considered out of network, and might not be covered even if you are on your parents policy.
Most of the times, being out of network might even be more expensive rate wise then getting your own policy.
Call a local agent and ask. Try Anthem Blue Cross as they have affordable rates. |

Obviously the terms of your mother's policy are the ones that will apply here but I can tell you that a family policy normally only covers children over the age of 18 who are also full time students.
I have to give Aetna evidence of college enrollment each year for my 18, 21 and 22 year olds so that they continue to be covered. |

Once you turn 18 you have to be a full time college student to remain on your parents' health insurance. Since you are not a full time student, you are on your own. |

Mom is right, I'm afraid. Insurance contracts have terms that describe in very precise terms who exactly is covered and under what circumstances. College students in many cases may still be covered as dependants because they retain residency in the state in which they are covered. Your residency is probably at issue if you're not in school.And if you're self-supporting, you're clearly no longer dependant. Indeed, you would be well advised to seek your OWN insurance. If you're doubtful as to entitlement, ask Mom for the contract. Look for the various definitions of 'insured.' If it's still unclear, ask ins agent listed on the contract and any of the variety of insurance ombudsman services that deal with consumer insurance issues. As long as 1. you are a full time student and 2. your mother claims you as a dependent on her taxes, she CAN keep you on her health insurance.
It's the tax dependent, insurance companies are starting to insist in, because there's a tremendous amount of fraud in health insurance, and they're trying to tighten up the controls.
I think legally, she has to provide more than half your support, and/or you have to live with her at least half the year. But that's a tax question. |
