So I ordered something from this company and as it turns out the item was back ordered. First it was 2 weeks before they told me the item was back ordered. Then when I read the email it says they will upgrade the shipping to expedited shipping for free- ok great. Now about a month later I receive a email that they shipped the item. But, they did not ship the item expedited shipping-they shipped the item ground as I had ordered UPS ground. So I contact them about it including the exact copy and pasted words from both emails (the one about it being backordered and the one about them shipping it). They soon reply telling me that they never sent the email to me. Now I know that this is not reason enough to sue them but, I'm sure I'm not the only person this happened to. Now the company is lockerz ( a free stuff site but, I spent hard work earning the 944 points for the item). Can I sue them by myself? If not if I can find other people who this happened to can I sue them? And if not can I sue them at all? |

Can you sue? Yes you can. Will you win? Well assuming the email is legitimate you do have a case for breach of contract, so I can see you winning. However seeing as you've suffered no damages the best I can see the judge doing is giving you nominal damages of $1 since you are legally in the right but have suffered no damages. I say learn your lesson not to deal with these people and move on. |

No. None of the reasons you've given are enough to sue anyone. Most people just choose to not do business with company's that give poor customer service. |

Here in the USA, you can sue anyone for anything, if you can afford to hire the lawyer.
What do you sue for? Damages. What are your damages? Zero. You got your item, and you didn't lose any money.
You want to spend $5,000 to give them a slap on the wrist? Doesn't make sense, but you can do it if you want. |
