I play in a touring band and last wednesday a person side-swiped our trailer and van causing serious damage to the vehicles. Our equipment was damaged and vehicles had to be totaled out due to my insurance. Can I sue the insurance company for loss of income from shows, loss of vehicles(even though I will receive a slight amount for the vehicle, but not enough to buy a new van and trailer) and loss of equipment? The person was drunk, but was not on the policy but was driving the vehicle. |

Yes. Go after the owner of the cars insurance company. Insurance goes with the car, not the driver. Get a good lawyer, and do it soon. You CANNOT suffer a financial loss if it was not your fault. If the other person don't have any insurance at all, then that's another story. But in this case, you can go after the owner of the vehicals personal auto policy. |

I could be wrong, but it sound like what you are saying is someone loaned a car to a person not insured. If that's correct, your next step is to bring suit against owner of the vehicle, as they are responsible for any damage caused by their vehicle. Their insurance company will then get involved. |

You're going to sue them because they didn't insure someone? You say they paid out a little bit . . . so you're going to sue them because they didn't make the car owner buy more insurance???
Sure you can, but you're going to lose. The only way you can win, is if you sue either the person who was driving, or the person who owned the car. Then after you get the judgement, you have to try to collect. You can try to get actual cash value of the equipment and vehicles (that would be, replacement cost less depreciation), and loss of income - but you have to PROVE which gigs you lost. You CAN'T get a new vehicle/trailer - only the value of the old ones.
The insurance company didn't cause the accident - or the loss of income. They don't own the car.
You need to sue the people who were NEGLIGENT - the driver, and the owner, if the owner let the driver drive when they knew he was drunk.
Generally, the place to get loss of income from shows, would be from YOUR COMMERCIAL PROPERTY POLICY. The policy that covers your equipment, in YOUR name, could ALSO cover "loss of use" if the equipment was damaged due to a covered cause of loss. This is also called Business Interruption coverage. |

Assuming you are not planning to file in Small Claims Court, you should see an attorney (as he/she will have to file on your behalf). The attorney will tell you that you cannot sue the insurance company, as they are not at fault for the loss. You sue who you think is the negligent party. They forward to their insurance company for possible payment. If they have insurance then you may collect under their policy. If this is not sufficient payment (assuming you win the case) then you collect against their personal assets. |

Yes, the owner of the cars insurance company! It is ultimately the owner of the cars responsibility since he/she loaned the car it will be their insurance company that pays....
it is called a lending loss....happens every day...
always be careful who you loan your car to because it will follow you and your rates if something happens. |
