Can I sue for getting hurt as I was volunteering repairing appliances?
I had a lamp fall as I was repairing a washing machine.I ended up having to have surgery on my finger.It has been months since the accident and the finger is still not the same.Workers Comp has paid for the hospital bills.But I was wondering if I have the option to sue them .

I had no insurance so Workermans Comp. had paid the hospital bills.But after months the finger is not any better.I was not paid for the time off of my real job and now I can't work because of this injury.I had to have surgery to repair a artery and tendon.The house is rented by a non profit org.Any help would be great on this matter

1) I would check to see whether they have liability insurance to cover you as you were on their property when you got hurt. 2)You always have the option to sue, but you may not win, for whatever reasons. 3) Do you have partial disability benefits at work? Check it out. 4) Also, If the injury prevents you from working at all, check with the State Rehabilitation Commission and Social security. You have the right to apply but may be denied services. 5) If you have dependents, there may a state program, aid to families, that may help. Good luck.

But if workers comp is paying for the bills, what would you sue for? The judge would probably say that everything is being paid, therefore there would be nothing to award.

I assume you were an employee acting as an employee and injured as an employee. If this is the case then your rights to suing the employer was null & void once the workers comp kicked in.

I wouldn't waste my time....to many down falls on this even your future employment. Won't look good on your resume.

Wait a minute . . . if this is work related, and workers comp paid, you can't sue. If you collect workers comp benefits (medical and/or lost wages) you automatically give up your right to sue your employer for damages. If this is NOT work related, then why did workers comp pay?

Anyone can try to sue anyone for anything here in the US, but if you don't have a good case, you have to pay the lawyer up front - usual retainer is $5,000 to $10,000 against their time, to start. Just because you can sue, doesn't mean you'll win - if the case is against your employer, and you collected workers comp, the case will be dismissed - and you'll have to pay the legal fees for your employer.
