i Switch insurance companies back in Feb. of this year. The new insurance company never filed the paperwork with the DVM. As a result my car was impounded because it said that i wasn't insured. However every month auto insurance was being taken out of my account as an EFT. Now i need a rental, lose a day of work to go to traffic court, and i don't have a car for the weekend. I am being inconvenienced for no fault of my own.

It would be helpful to know what state your in.
In California they will not impound your car for no insurance. They just give you a ticket.
The insurance company notifies DMV that you have insurance. Only problem is if the insurance company has the wrong VIN # which you gave them, they will not get notified. I see this problem all the time. All the agent needs to know is get the VIN # corrected and then they will notify the DMV that you had insurance. And, get an ID card going back to the date you were stopped and show it to the judge and ask the judge to reimburse you for your fees.
It is not the insurance companies responsibility to make sure they have the correct vin #. It is yours. But the insurance company can help solve the problem. |

Sorry, but it was YOUR responsibility to see that the proof of insurance got to the DMV. Surely you received notices from the DMV ordering you to submit proof of insurance - you should have contacted the insurance company yourself & made sure they did it, or sent it in on your own. Sorry, but you'll be laughed out of court if you try and sue them. |

You should keep a copy your proof of insurance in your vehicle and/or on you so that does not happen. If you prove you had insurance without lapse you should be able to get out of that ticket, but not the impound fee. |

You could litigate, but it would be expensive and wasteful. First try the following steps:
PRE-CONTACT
ALWAYS: Document your losses (this is just the homework and evidence to make copies for use in any of the steps) !
1) Call you insurance company and explain to your insurance agent or representative your situation. Advise them of your demand. Find out what they can do for you.
2) If their offer is not good enough and you have tried to be reasonable and get their best offer on the table, then talk to a supervisor and advise him/her of your intention to seek legal help if they or their manager cannot give you a better offer.
3) obtain legal counsel. some workplaces will have a form of legal insurance so you pay small monthly premiums and they will in exchange offer low cost legal advise and document preparation. you can also get free legal advise online. once you find a referral to a known atorney, you can check that they have a bar# and are a legitimate legal attorney at:

maybe you should if that insurance company does not offer any kind of refund/etc. for your time and losses. if it has happened to you, maybe it is or has happened to another customer of theirs too. |
