I have my home items in storage for at least 4-6 years. I went back to get something out of storage. My furniture has mold on it and some other things have mold growing on it. Can I sue the Storage Company for neglect of my things inside my cubical? I pay a fee and insurance every month. |

Well, what maintenance were they supposed to be doing on your furniture? If they were supposed to be DOING something, like weekly polishing, you can sue for failure to perform. If they were only renting you the SPACE, then, well, they did that. You can STILL sue them, but you're not going to win.
You stuck the furniture in there for six years . . . YOU'RE the guy that neglected it!! |

File a claim on the insurance. That's why you are paying it. The storage company likely had a clause in the contract that states that they are not responsible for your items.
The only way you might have a claim is if the unit is supposed to be climate controlled, and you can prove that it was not. |

Depends,If you had your stuff in an environment controlled storage ,and the system failed which then caused the mold then yes.But if was just an average storage unit ,then I am sorry but they are not at fault |

Of course you can. Will you win--I doubt it. To win would imply that it was somehow the storage companies fault, and it doesn't sound that way to me. |

In order to win, you will have to prove that the Storage Compant was somehow negligent. Did the unit have a leaky roof? Was the unit suppose to be heated and it wasn't? Was there water seeping in through the floors? Was the unit suppose to be temperatureand humidity controlled but it wasn't? Have others who rent a unit there experienced the same? If you do not have something similar to one of my previous points, then you will be hard pressed to win a case in court. The Storage Company might say that some of your items may have had mold on them when they went into the unit and it spread.
As for the insurance, you may want to read your policy wordings very carefully as I don't know of any insurer who covers mold, as mold damage is damage that occurs over time. That sort of damage is seldom insurable. |
