Yes. You can take money without penalty from a 401(k) beginning at age 59 1/2; working or not working has nothing to do with it, unless your particular plan has rules to the contrary.

At age 59 1/2 you can withdraw without penalities, however 401K plans are pre-tax and all withdrawals will incur income taxes. If you don't need the money because you are working I suggest you allow it to continue to grow. If you are withdrawing for a business venture you will probably have additional tax write-off anyway. Consult a tax professional. |

You can withdrawal money from your 401(k) at any time regardless of your work status. The question is really whether you can do it PENALTY FREE or not. After age 59 1/2, you can take distributions penalty free, though you will be taxed according to your income tax bracket on the distributions since they were contributed with before-tax dollars.

You can take a withdraw from your 401K after 59 1/2. It doesn't matter if you are working or not. There is no penalty.
Depending on the type of 401k (traditional or roth) will determine if you need to pay taxes on it. A withdraw from a traditional 401K is like getting additional income, and it taxes at your income tax rate. A withdraw from a roth 401k are not taxed. The money was already taxed.
You still should consult your tax adviser because advise from the Internet will not help you during a tax audit. |

Why are you withdrawing and working at the same time? Do you need the income beyond what you can earn? Do you just want a job to keep you busy in retirement? Are you trying to convert it to non-qual status?
Make sure you have a legitimate plan before you take action. Insurance folks are not the people you want to ask this question to. Talk to an accountant or fee-only adviser. |
