Can a car be double insured?
I have an insurance policy that says that anything I drive temporarily will be covered by my insurance. If I'm driving a car which is insured on a separate policy, but with me as a driver, does that mean one of the policies will have to pay out cash in the event of a claim?

I live in Texas.

Your policy, if you read it carefully, will also tell you that if the non-owned or temporary substitute car you are driving has its own policy of insurance, that policy is primary and yours will only be excess; meaning that your policy will only pick up if you have limits higher than the described vehicle and then only the amount of the difference between the two coverages.

The total amount paid by all insurance companies is never more than the actual amount of damage and liability. You are not allowed to profit from an accident (unless you are a lawyer). However, if you cause an accident in which a third party (not you or the vehicle owner) has property damage or is injured, then you will be covered for liability up to the limits of your policy, even if the car owner has lower limits.

No. In TN, the insurance follows the owner of the vehicle so If you borrow someones car, their insurance would be primary. Your insurance would be secondary if they were to sue for more, but the insurance co is not just going to give you cash.
I would check with TX laws because Im only licensed in TN.

No, what it means is that your insurance will have to pay and if you or the owner of the other car try to collect on both and get caught it is insurance fraud and is punnishable by fine of $10,000 and up to 20 years in jail... But hey its done all the time.. Good luck Grant M in Pennsylvania

Generally speaking, the car that is "at fault" is the policy to pay up first. If you are driving someone else's car and you are at fault in the accident, their policy will cover the accident if they have the appropriate insurance.

In the event that they do not have proper coverage, etc., then your own insurance will kick in.
