Usually minimum earned premiums are disclosed up front...I am always amazed at how many people don't actually read the quotes they're provided!

Yes. They probably have it written into the insuring agreement (contract). They can do whatever they want, as long as it's fair and not illegal, as long as you agree to it by signing the policy application.

I would think it would depend on your initial agreement with them. If you signed that you would agree to it, then I'm saying they could do whatever they want.

Yes, it's standard practice in the insurance industry to "pro-rate" your policy and keep 10% of your unearned premium. However, if you pay monthly, they should not be keeping any money so the pro-rating would only apply if you have paid in full, half of the premium, one quarter of the premium, etc. If you do pay by the month, you don't have any "unearned premium," so if this is the case, you may want to contact the Florida Department of Insurance (DOI) to report them.
