Can a hospital refuse you to have a surgry because your insurance company will not pay for it? ?
they are telling my aunt that she cant have surgery because her insurance company will not pay for it, they are also telling her that unless she can come up with the money up front they will not do it! in my opinion that's a bunch of bs! i thought that no hospital can refuse health care to any patient and that they have to work with them as far as payments go?????

A hospital is obligated to provide enough care in the Emergency Room to stabilize a patient. That's it.

Hospitals certainly aren't expected to provide elective care for free.

If your aunt wants the service, she'll have to come up with a way to pay up front. Or figure out a way to get her insurance company to approve it, if possible.

No hospital can refuse *emergency* care to a patient if the patient is in *immediate* danger of dying without the care. There are no laws saying that hospitals have to perform surgery on patients who cannot pay and do not have insurance.

Why won't the insurance company pay? Do they feel the procedure is not medically necessary?

If an insurance company refuses to cover it, then the surgery is determined to be unnecessary.

So, no the hospital does not have to work with a patient on a surgery that is not life saving.

Sorry.

Don't think that universal health care would help either. Odds are high that fewer of us will be getting surgery, not more.

You should be able to find help for her through you county hospital. Contact you county's health department (find them in your phone book under the government pages). They can help you get the care she needs.~~

That's only for emergencies. If the surgery or treatment is elective - even if it's life saving, the hospital can refuse to do it without payment.

That's why we need universal heath care.

BTW, she can appeal the insurance company's decision. It might pay to find a lawyer who specializes in these appeals.

Maybe if she can come up with a payment plan beforehand that will work for the hospital and your aunt.

But to actually answer your question, yes they can refuse. They are not obligated to do their jobs for free any more than you are. Hospitals are not required to give away free time, services, supplies, doctors, etc. If you're in an emergency, they need to get you to a stable condition--but that's it.

Hospitals are not allowed to refuse EMERGENCY treatment in life threatening situations. They are not required to provide free health care, and they are not required to offer payments.
