At a car dealership, if you have an accident in one of the company's cars, new or used, can they make the employee pay for the damages? Isnt that what insurance is for? |

No, they can't. That's EXACTLY what the auto dealer liability policy is for.
Actually, there's an exclusion in the employee's PERSONAL automobile policy, so it won't even cover them personally, for an accident arising out of the business of selling or fixing cars. You NEED the auto dealer liability policy for that.
Additionally, if the employer made the employee sign an agreement that they would be responsible ANYWAY, well, I don't think that would hold up in court. |

This depends on the state. Your boss probably can charge you for damages to company property, but in many states the deduction from your paycheck will be limited (10% is a common figure), and in some states if the loss is covered by insurance then it is illegal for your boss to do this. You should find a local lawyer if your boss is doing this to you. |

i would guess it depends on what you did to damage it...i would contact your insurance company and see what they say..you gotta remember they will have to pay higher premiums on their insurance if it is turned in... |

Do you know for sure that they had insurance on the vehicle? If not, I can see why they want you to pay.
As others are saying it really depends on the circumstances of how the vehicle was damaged. If you took a baseball bat to the car (for example) then they should make you pay for it. If you hit a deer crossing the road then no, they shouldn't make you pay for it, at least not more than the deductible, but even paying the deductible when not negligent would seem strange.
So in general I would say it would be weird that they make you pay for the damage...if that is their policy your better off insuring the vehicles on your own. |

Yes, they can require you to pay for the damages.
You should have sign a contract when you were given
the car. It WILL state in the contract what the agreement
terms are
Also, were you driving the car for personal use, when
the damage was done?
Or for company use?
That is the biggie question. If it was personal you most
likely owe for the damages. |

If it was your fault, yes, they could.
Insurance is for accidents. If you did something through negligence that you knew you weren't supposed to be doing, then your employer quite likely, and rightfully so, I might add, may not want to turn a claim into their insurance. They also likely have a high deductible and if the damage you caused is under the deductible, there is no point in turning it in as they wouldn't get anything back anyway so they are collecting it from the person at fault. |

if you are an employee then they should have you covered on thier policy for driving the auto. Companies carry insurance just for that reason. |
